We moved house on Friday and are up to our eyeballs in other stuff.

I will send in documentation to the court, I am not going in person, too risky as I know I won't be able to keep my cool.

Almost forgot all about this!

I guess I will hear something in the post over this. I would have attended but it was impossible as I am on a 4 week course and unable to miss a single day.

Will post whatever I hear when it comes through.

Letter came through today from the court to say that I had lost the appeal and that PCM have acted within their rights etc etc which all comes as no surprise. I believe I also now have to pay money to the court for fee's although this is unclear.

Got a spiel through about PCM acted proffesionally complying with BPA codes of practice and also being fully trained and licensed by the SIA which regulates the industrry (thought this was unregualted?).

Anyway this all comes as no surprise, I know the sort of mess this country is in and the continual state of injustice honest citizens regularly face... It so happens my personal circumstances have changed significantly for the better since all this went on, so I will just chalk it up to experience and laugh it off knowing that actually this won't happen to e again and that I am quite fortunate in life. I just feel sorry for all those victims about to endure the same treatment who may be going through a hard time in life right now for either personal reasons or the state of the economy etc.

Another victory to the dishonest who choose to milk the loopholes and oppurtunities. Human nature I guess, money and greed.

A great shame, but not altogether unexpected.

Last week, SWMBO went to local Argos to collect a heavy and bulky pre-ordered item, drove around the back as instructed by the front desk only to find that it was impossible even to get into the collection area because of parked cars. She drove the car back to the carpark (double yellows everywhere else and the 'Blue Meanies' seem to pop up whenever there's the opportunity of bagging a few more bucks for the Council's pension fund. Then she walked around to the front again and complained about the parking. She was told that it was a constant problem ... and as it's offroad the 'Blue Meanies' have no jurisdiction. The car park is largely used by workers in the nearby offices, but they have more cars than allocated spaces. Anyway, one of the Argos 'lads' carried the item to her car - Streaky

The court thing reads that "Argos employ PCM to control the car park". 1) They don't and 2) They gave me permission. I must admit to not getting around to sending that letter to the court as I have in the last 8 weeks moved house, changed jobs and been busier than I have ever been focussing on a course that I have been after for 10 years - thats just the way it goes.

So you lost the appeal and feel badley done to...yet admit you didn't send in a bit of evidence that may have swung the decision in your favour?
Am I missing something here?

big mistake, allowing the court hearing to go ahead when not attended. Not surprised it was lost.

I wouldn't be at all surprised if you get whacked for the other parties' costs. A shame you couldn't be bothered/were too busy to mount a decent defence and decided instead to waste the Courts' time; it would have been nice to see the parking enforcement nazis lose out.

I have to say that this fact gave the Judge only one option.

They will have turned up at court with their spiel and basically the Judge has seen a Claimant who after filling out a claim and using the court's time not only does not want to come to court to give testimony but fails to provide the key piece of evidence.

If you had tuned up in court and given personal testimony, referenced the case law that people referenced for you and brought the letter with you, that would have given the clampers very little chance of defending your claim.

Even if you could not come to court a well written statement *with the letter* would at least have given you a good chance.


In small claims cases, costs are rarely awarded. However, the exemption to this is where one party has put forward what could be seen as a vexatious case.

Don't be surprised if you get a bill for a few hundred quid of costs.

After rall the fuss and rigamorale you've kicked up I can't believe that you couldn't be bothered either sending a letter or turning up at court.

Seems almost insulting to all the people who have offered considered advice over the months to have it all wasted because the OP simply couldn't be bothered.

i think that if you read between the lines he has a life to get on with, and although important as the court case was, waiting for a course for ten years and not being able to miss one day might over rule the court.

(a couple of hundred quid vs screwing over your career = no brainer!!)

If you open you eyes and read what I have said, as Landshark has eluded to below, you will see it is nothing to do with not being bothered or not wanting to go, I COULDN'T go - it was never an option.
