Been following PH for a while now, but very much need some advice.

Have just had a NIP through for 71 in a 40 and to say I am worried is an understatement.

Here's the deal: I came off a roundabout following two Audis, onto a 40 dual carriageway. The car behind (Audi 2) pulled out to overtake just as I was approaching him, so I slowed down and we both overtook Audi 1. Audi 2 then pulled in to let me go past. I went past him under pretty full acceleration, as there was a van parked on the inside lane, and I anticipated that Audi 2 would have to pull back out into the outside lane. Exactly that happened as soon as I was past, which is when I realised who was in the back of the van. I chose not to slam on the anchors as I was equally aware of Audi filling the rear view mirror.

I'll gladly hold my hands up to being over the 40 limit, (and I was definately driving) but I'm not happy for this to treated as a 'normal' 30 over the limit, case.

Can anyone give me some advice as to how to proceed? Does the 30 over = ban apply on 40 dual carriageways the same as on single carriageways?

I guess it wont help that I've already got 6 points (82 on a motorway then 40 in a 30 - the second of which was fair enough!)but they were in Feb 01 and I was beginning to see the light at the end of the tunnel!

I wouldn't bother explaining the circumstances to the magistrates, they won't be interested. Your best result would be a short ban (e.g. 28 days), then you won't get points. However, I fear you could be looking at 5 or 6 points which will put you on 11 or 12 (which means automatic 6 month ban).

You could try the "not signing the NIP" loophole...

I would think you are far better off getting points for refusal to name driver than for admitting it...

Pepipoo would be a good website to check first

PePiPoo is good. Makes a lot of things more black and white.

Looks like I am out of the boarderline area though - so I guess I'll have to hope for this 'Magistrates discretion'. Seems pretty arbitrary. I guess the date the points are awarded isn't the one used as that would take me out of the three years (if it dragged on a bit).

Still can't really tell if there is much distinction between a dual carriageway 40 and a 40 past a school.

There is some hope

My mum got a FPO (3 points and £40 at the time) for doing 67 in a 30 caught by a gatso.

You can try (and hope) to play the sustem on the Conditional Offer i.e. 60 notes plus 3, but I think this could be, note only could be, doubtful as ACPO do not like low flying pilots and have decreed in their enforcement guidlines:

for 40 mph limits = 46 up FPT, 76 up Court appearance and possible ban.

Fingers crossed that you just scrape in on the FPT.
