I learnt that under questioning you answer honestly and concisely.

If they need to know more they will ask more questions.

Dont elaborate, if you do, the additional information that you give may be used against you.

yes

It is the only way to go. And never be drawn into speculation either. Only ever state a fact as fact.

Perhaps this would have made a difference. I would like to think so but would expect not. I've been lucky enough to have had only two previous encounters with the law in ten years of driving both of which, I hasten to add were much more pleasant affairs.

also, try not to say "err" when considering your answer during a tape recorded interview.

When it gets transcripted into print it looks awful if every 5th line is "err"

hehe forgot about that. Oh the happy hours whiled away re-reading the transcriptions as a trainee.

I used to think that the 'never talk to the police advice' was paranoid but I'm increasingly coming around to that way of thinking.

Also the current caution is rather misleading and intimidating (whether its designed to be is not really for discussion here)

Its always best to keep your gob shut.

On Topic, Its a shame that things have come to this, if i was in that situation id probably ask the copper to quote me the exact section, just to make sure he (and I) are fully aware of what he is doing, Id also ask to see he warrant card and get all the details off it.

Holy crap! Just watched that video, I'm never talking to a policeman again! I know its yank law but still.

I would like to hear what Vonhosen has to say about this. I'm relatively new to ph but have read the odd thread with comments from him. Could be interesting.

Got a template letter from pepipoo all filled out and sent off the cc this afternoon. Watch this space...

Maybe Von and Daizee (sp?) are one and the same person??

Joy, two years without "the law is the law" and "policemen are never wrong" etc etc

as soon as if mentioned loud music i would have shown him the nonexistent stereo then drove off. smile

i would make a complaint about it and try and get him taken down a peg or two.

i would have also asked for a copy of the calibration cert of the spl meter used to test your exhaust.
when he says he didnt use one i would get quite sarcastic about his magic db sensing powers.

Interesting vid, but does it apply here? Do we have a "5th amendment"?

We have a privilege against self-incrimination which is broadly similar. I think he makes a lot of points that are definitely applicable here.

The police officers side of the story was good too (link on right of vid).

All food for thought.

Von is pretty straight down the line, as much as the more simple people on here want to pull him down for his cold objectivity.
People may not sometimes like what Von has to say, but he does say how it is.

What I dont like about this is that you get one numpty officer and everyone thinks all officers are the same, and all officers think that everyone's implying they're the same, none of which is good.

Similarly being a member of PH everyone else in the world thinks youre a petrol head who breaks every speed limit, picks up a summons every day and runs over babies and cyclists, whereas in practice just about everyone here watches every speed limit and other road user and supports the government in it's safer road initiative to raise limits in line with common usage.

Section 59 is an abortion and it's becoming increasingly evident that police officers cannot be trusted with such open legislation.
"This officer cannot be allowed to carry on like this, he embarrasing his own police force and ruining the good work of other officers." - I've heard of similar use ofsec 59 and by the sounds of it there's not much you can so.

Just the sort of law that moronic pc's should not be allowed to enforce, how exactly could he tell if it was loud? did he noise test you? utter wayne-kers and so frustrating if you have to deal with people like that.
