25 Calls to them since Monday afternoon. They have never wrote to me to say they are not honouring the warranty up to now. (just a phone call to Austec)

I rang at 4pm, after numerous promised calls. 4:30pm, I have the claims manager start spouting off about shims, and some other twiddle....

"Hang on, It seems you are still not willing to accept this is a mechanical failure, even though you have a letter from TVR stating so".

"But we still...."

"No, hold on - Put whatever you want to say in writing, please write to me what the companys intentions are with this claim. Can you send it through on fax or email, along with the second engineers report before end of play"

"yes"


Guess what...... Nothing!!!!
Court paperwork will be with me Monday, I called for it straight after the excuses started once more.

  • My trump card is a letter from TVR stating mechanical failure. "The component failed".

  • My insurance is for "mechanical failure".

Justin, you do need to tread fairly carefully to get the engineers report, they are under no obligation to show you any part of it as they have paid for it, not you.
I found the best way around this was to be polite(overly, given the "could'nt give a F**k" attitude).
They will probably try to say that second report confirms wear & tear & thats the end of it. At this stage you can say that they are asking you to accept the findings in a report that you've not seen & they should relent. I was able to pick my report to pieces, there were so many errors, i had to check it was my engine they'd inspected!
(note that i may be talking absolute bollox & they may just fax it to you, in which case, ignore the above.)

As i mentioned in my previous reply, my crank had snapped, the inspection said that oil starvation/low oil had caused the crank to run dry, picking up a bearing & seizing (sp?). Low oil was therefore abuse & the primary cause, the crank snapping was a secondry result. No valid claim.

My arguement was over the fact that the warranty specificaly covered "mechanical Breakdown", regardless of how the component came to be broken (& it was not low oil), it was indeed broken.

If you haven't already spoken to him, Paul Giddings is head of engine build at the factory & will help you all he can.

Just out of interest, have the factory stopped any form of goodwill contribution towards rebuilds?

It has progressed into an offer being made from Aon Insurance services. Half of the total bill of £4090 in fact.
They even made me get statements from the last service centre, stating they had completed the service correctly. (TMS) I found it a little embaressing to ask for such evidence, as it questions the integrity of people, and organisations. I supose its all part of their plan to make it arkward.

Trading standards have responded, and are looking into it all.

I have to FAX off the invoice from Austec, for them to pay their selected parts, and they should settle in 5 days.

I have asked for a "Pro-forma" invoice to see how this progresses. I guess its not 5 days, I will wait! I will post back shortly.

Hi Justin,

This is good news as I can see. Something worth thinking about is that if I were a businessman with less morals than I have, and I ran a warranty company then my offer of paying half the cost would be a last ditch effort in getting out of paying the full cost.

Basically if they have offered half, they know they are liable and are going to lose, otherwise why would they give you £2000 already if they are not liable?

Of course the warranty you have paid for means that they have to pay out for the full cost and not half, so keep on them!

A letter arrived last week from the warranty company, outlining that the financial ombudsman was investigating them. (I don't know what they wanted me to do about it) I didn't respond to it, and look what arrived today!!!

More power to you mate!

Just got back from Austec to see mine.
Had a good chat to Paul re. your engine / engines in general and the future is looking somewhat rosier!

Only problem now is the s-n-a-i-l-s p-a-c-e that TVR supply parts!

Hope the car is back on the road soon so you can start enjoying it.....in the winter....!

Reckon we've had just about the best Autumn weather in recent memory, and all we've got are promises ("..should be next week!" )....and no car....

I remember now. Can't believe its still not repaired yet. It happened a while ago did'nt it? I remember the car as well. I was very interested in it when up for sale, but was out in India so did'nt get chance. just out of a matter of interest, any probs with it so far, apart from a crazy back end?

A while ago.....you could say that! Try July 15th!!!
The only problems have been a dodgy immobiliser wire and leaky oil pressure sensor.

The biggest pain in my arse (apart from the obvious [ahem!] 'rear breakaway event') has been the frankly ludicrous amount of time I've had to wait for the supply of parts from TVR themselves.

You'd think they were trying to put people off!

When I have had it on the road......oh !!!!!!!
