I have a question relating to right of way when joining a road from a private driveway.

For example, if you're on a minor road at a T junction turning right and the traffic on the major road signal to let you out, you turn right to find that a vehicle on the opposite side of the road leaving from a drive way also turning right interprets the same signal then also turns right, this results in the two cars accessing the major road from opposite sides and colliding in the middle.

Does the driver turning right from the minor road have priority over the driver accessing the road from a driveway?

Wouldn’t that make it equivalent to a crossroads, rather than a t junction, or have I misunderstood?

If so, my assumption (although I don’t know) would be that crossroad rules would apply.

I think in reality neither driver could claim right of way over the other and the practicality of it if insurers got involved would be that both drivers would be found to be liable in some way and would both lose their no claims.

It would be argued that both drivers when manoeuvring onto a new road should be exercising due care and looking for other road users, not assuming because a driver on that road flashes their headlights, or waves them out it is safe to proceed.

This highlights the risk of flashing lights to indicate you are giving way - the driver seeing the flashed lights is very likely to proceed without sufficient caution, and may fail to spot different hazards.

neither has right of way
right of way is not really a british motoring law concept
neither has priority
effectively the first out gains priority
but both should drive with caution and be prepared to give way

I never flash people out, fraught with danger.
Horn or flash - rarely of any use.

Flashing lights - only to be done to alert of presence, nothing else.

Almost daily, a car slows down and flashes to let someone turn across them into a side road, whilst I am simultaneously cycling down the nearside, creating a perfect collision course for me. Luckily, I slow to be able to react to gaps in vision, so manage to deflect the conflict caused by such idiots.

After a quick google, a couple of the suggestions for tackling this situation were;

Make eye contact & sort it out by hand signals with each other.
Whoever got to the junction first has priority.

Personally, I would pass nearside to nearside... with caution.
