My son has received a letter from the outgoing franchise operator Abellio, asking for the repayment of just over £2k in over payed wages for a short period in September of this year. As he has never worked for the company, but was offered a temp job back in the summer of 2016 but not taken up, it's clearly a mistake and he has checked his bank statement clearly showing no money received. They want immediate repayment in full via bank transfer or cheque, if they retained his bank details from the original job app process can the remove funds without permission. I would like to know if anyone from Northern trains has received a similar letter or can confirm the TUPE date .

DELETED: Comment made by a member who's account has been deleted.
TUPE implies that he worked for a company they took over.

Firstly he was offered a job but turned it down, the Tupe reference is in relation the Northern Rail franchise change from Abellio to Arriva which happened early this year. The 11th of September is stated as the official tranfer date. His bank statement clearly shows no monies transfered.

Good point. Also it's crucial that he does this on letterheaded paper.

Letter is correctly addressed to my son. He graduated in May and now works in an unconnected industry. The job from Abellio was accepted so they would have his bank details, it was a zero hours contract and several weeks passed before any shift was offered by which time he was back at uni . He phoned to withdraw from their system and was sent a P45 despite never actually doing any shifts, this was just over 12 months ago.

So the P45 will have zero values on it, in which case just send a photocopy back to them?

Just wrote to the sender of the letter and tell them that you didn't work there and didn't receive any payment of that is truly the case.

i would write a letter clearly stating no money was received and you have bank statements to prove. Any further letters will be considered harassment as it is clearly a mistake at there end.

No NI number quoted , two further points following converstion with my son. The original interview was spring 2015, he also received one wage slip over 12 months ago(but no money in his bank account) and a Christmas card !

This sounds like a mailing error and not something to become overly fussed about.

Out of interest, what has this, apparent clerical error, got to do with the ICO?
