I've recently left a company about three weeks ago and was told that I would be paid for the two weeks I had worked in November.

However, it is now the 8th of December and I've still not been paid.

I was due to be paid on the 30th of November and received an email from one of the directors which said that they've had some issues transferring money from a foreign account to their UK account so this has caused the issue. But - I would be paid early this week.

I checked with my ex-colleagues who mentioned they also hadn't been paid and confirmed the story the director gave. I emailed the director back last Wednesday who apologised for the delay and said that I should be paid Thursday or Friday this week. I chased them up yesterday (Friday) as I still hadn't been paid but received no reply.

My question is, what legal standing to I have to get the money owed as I've left the company and what would the best course of action to take.

Many thanks

You can claim via the tribunal.

First step is informal discussion with Employer and to try and get an agreed date.

Second step would be informal conciliation via ACAS

Third step would be Employment Tribunal.

Unfortunately, as your ex-colleagues haven't been paid either, it looks more like a "can't pay" rather than a "won't pay" so I don't think going to ACAS or ET would necessarily help. It's not that they need somebody to threaten them with a big stick, they just don't have the money.

Thanks all, I'll try a chat with my ex-employer initially, however they've been pretty stand-offish so far.

I've also never had a pay slip or my P45, so it's proving slightly difficult to actually work out the money owed.

I've dropped ACAS a message and they're going to give me a bell.
