posible unfair dismissal claim
Discussion
Folk's,
I was dismissed from my last employer earlier this year. And have put up a claim for unfair dismissal through my union. Now it turns out the union reps have not put the paperwork through for legal consideration by the union with in the three month period for claims. This now means any claim I might have had is out of time and out the window.
Does anyone know if there might be away to still pursue this matter, or is it tuff titty I lose. Could I take some sort of action against the union reps for not doing their jobs.

2 things...
1) You had such a claim and you just let it lapse the 3 months?? You didnt chase it up or anything and didnt start to get worried at 2 1/2 month stage... I would say its your own fault for not chasing it up.
2) against the union reps, I guess you could do this, but who would do it? Is there a body that overlooks the union or would other union reps do this? Will it affect your membership? (you didnt let your memeber lapse and this is why they did nothing did you?)

I was involved with other things that were out of my control, that took me out of the picture for a month and a bit and have still got legal implications. Unfortunaitly I trusted my union reps to do their jobs.
I am still awaiting confirmation from the union head office if there is action they can still take for me.

Hi,
New member here.
I suggest to get your union reps in gear, you do their job for them and prepare your own case. If you hand them the case gift wrapped, they are much more likely to act on it.
There are many legal routes to challenging a dismissal. It really all depends on what you've been sacked for. There are a few statutes you can use and also some interesting common law defences too.
