Hi all,

Just wondering if anyone cam offer a spot of advice - I have been offered a new job but my new employer would prefer if I started within 6 weeks, current contract states 3mth notice period. Just wondering where I stand?

Obviously the best thing is to chat to my current employer and see if I can negotiate it down, just wondering if they refuse to move what my rights are?

If current employer refuses, very little you can do. Of course, you can breach the contract and quit, you will have none of the benefits of leaving via notice (holiday entitlement for notice period paid, chance of anything other than an acknowledgment of working there should you ever need a reference in future) but the current employer is likely to do very little for this breach. They would expend more than they would gain, unless you are a pivotal part of an organisation and have a calculable income to the company, which they can quantify as a loss and seek compensation for.

Just ask your company, I had something similar recently.

I was on 3 months notice but left after 2 by agreement.

To be fair though I had handed my notice in before I had a new job to go to, was lucky to find something quickly.
