I think you have to formally reject the car and ask for your money back. Also, it's quite clear that they either deliberately lied about the car or they didn't carry out a full AUC service but sold it as an AUC car. Add to this a dodgy MoT that they appear to have done, they are on a very sticky wicket. I would be looking not only for my money back but some compensation for the hassle and costs you may have incurred. I would be clear about taking this further, especially if they did the MoT and would be reporting them to the DoT for this alone, and Trading Standards for what appears to be fraudulent misrepresentation. Are they part of a chain? I have had a similar M5 problem with a large garage chain.

Good luck but I would suggest you're taking a big risk. I'm surprised they agreed which would add to my concern.to be honest the dodgy map is the concerning bit, how long has it been driven around with that? what quality fuel used? what early onset damage could have been caused to the engine?
not something I personally would want to worry about if it spins a shell or melts a piston shortly down the line, will not be a cheap fix under any drivetrain/engine circumstances. I would definitely be wary.
