There is obviously third party negligence which is a different matter. Seems unlikely in this particular case to me.
So without any knowledge (unless you have an inside sccop) this accident was his fault and the BBC / Morgan Cars bear no responsibility at all......

Fred is what, 6’4” or so, and bulky high up….. and he’s got a massive head if you remember then trying to fit a helmet on him once…! so probably the worst build for driving a Morgan 3 wheeler. CoG was probably way too high.

I heard he’s at least bust his jaw, but if that’s the case he’s probably done far more soft tissue damage. I’m sure if it was minor we would have seen him showing off his battle damage.

FF's employment contract will have been written by a legal professional. If the BBC were to allow any of the guys carrying out stunts to do this without some serious disclaimers then I would be amazed. it would be very unusual for a presenter to sue the corporation, given that the stunts were carried out willingly and that FF has form for pushing the boundaries. I think it wouldn't go well for him.

he did that TV programme about being bulimic didn't he? He's suffered with mental health issues at times, but i am not sure it's the main reason with this.

Again, with the benefit of some hindsight I think that's a little unfair. The stuff he did before and since TG shows the guy is chock-full of personality (but you have to be on Youtube to see any of it). I think he probably felt he needed to 'tone it down' for the big job on the BBC and maybe went a little too far but he's a good egg.
More than happy to give you benefit of the doubt on that as I've studiously avoided watching anything with him in it since he left TG.

I'd say driving a three-wheeler becomes a stunt activity at a surprisingly low speed.

Unfortunately we (and TV presenters) have been conditioned into thinking you can take major liberties with any car and you'll be OK but a Morgan three-wheeler doesn't fit that template.

It'll be an insurance claim, a few million I would think. His solicitors will have told him not to say anything.

The task of what though? Top Gear drive almost all the cars on the show on the test track, that doesn’t mean they’re track cars.

Is it just he new ones? My Dad used to take me to Cadwell to watch vintage bike racing (on the back of his Vincent!), Morgan 3 wheelers ran in the sidecar class and they used to hammer round the club hairpin at a fair lick and never looked like tipping. I seem to remember reading they were quite popular race cars back in the day. The only sidecar we saw flip was (I think I recall) a Velocette sidecar with two ladies piloting it who lets say, had plenty of natural cushion to help their fall when the sidecar wheel dug in and they gently tipped over.
