I think the problem is with claims of this sort is that the insult was based on his most obvious attribute, in this case being Irish. If the "victim" has big ears he'd undoubtedly been a stupid, big eared rather than an Irish one. If he had one hand would have been a stupid, one handed , except that of course is actionable too.
The intent of the insult is in all cases the same, but by using Irish instead of big eared or ginger or fat or whatever we now have a case of discrimination.

Amazing how for 10 years someone's conscience allows them to work on a programme famed for chortles about slopey bridges and prostitue murdering lorry drivers and then the minute the opportunity for a no-win-no-fee fast buck arises based on exactly the same type of thing,it's suddenly a massive wrong that needs financially righting.
