I was always confused about this. Barrymore or someone had sex with the victim as it was alleged he suffered trauma but the act itself can cause trauma (hence why hiv was past more easily between gay men). An the victim had drugs in his system. So why was it not a case of boy meets Barrymore does a load of booze an coke has some rough sex an afterwards high an drunk falls in pool an drowns. Was there anything to suggest he was held under water deliberately etc
Stuart Lubbock was heterosexual - no one has ever been able to produce any shred of evidence or hint that he may have been gay. Does that 100% mean he would not have consented to having sex with Barrymore - he only met for the first time that evening - I guess not. Still, there were only nine people, including Barrymore and Lubbock, at the party so you'd have thought someone would have been able to provide the police with a coherent version of events.

So SL was not gay but does that mean Barrymore raped him (I assume evidence showed they he sex) but again does it mean he drowned him or was it an accident. I have little knowledge of the case so wonder why it was thought to be murderAlas, it seems the truth will not out.

I remember reading an in depth account of that night and there were lots of unanswered questions and suspicions about what actually happened (that he was moved to the pool after he had died), and the delay in reporting/time of death etc.
We will never know the truth, but I suspect that someone at that party escaped justice.

thanks made a good read an basically says something went on that night an the 3 people who would know are not saying what which leads to suspicion. The victim did have injurys to one area of his body but not others and the level of drugs in his system may have also caused his death.So did barrymore murder him...its not clear but it is certainly clear he has not told the whole story
If I remember correctly the arrest was deemed unlawful because the person arresting him did so on the basis of someone else having the knowledge (i.e if the other person had doen the arrest then it would have been alwful). Therefore, whilst Barrymore was technically right, the fact is he still could have been legitimatley arrested.
I spose by winnign the case though he has got a lot of people thinking he should/could never have been arrested.

So I could be as current and relevant to be a police officer conducting an unlawful arrest?
My post was that BBC News reported that unlawful arrest this afternoon. I don't know why the BBC chose to mention that unlwaful arrest today. Perhaps the BBC News has to report all of the facts, rather than just some of them?
