Trinity College didn't make a complaint of criminal damage apparently.
Why does that matter?
Because it's their property, they're essentially letting XR dig it up.

There is no crime.
Interesting, ISWYM.

There is crime for sure, but one party is pretending there isn't for some reason, and are have as yet failed to report it.
Its private property, it's most definitely not a crime unless Trinity want to be, which by all accounts they wont. I'd imagine they'll let them have their little show and hope they bugger off.
Sure, I get it, though there's still a crime it's just that the victim has chosen so far not to report it (how can there be something to not report if there's no crime). It's also likely that Trinity will get on with fixing their lawn and carry on carrying on, as you say. At least the apple tree is still around, so that an apple won't fall on somebody's head ('please keep off what was the grass').

What crime is it when someone allows someone else to dig up their garden?

Permission hasn't been given; a report hasn't been filed. Same ends, not the same means.

In these circumstances you have to have a 'victim' so with no report there is no victim, so no crime.

No one can report it on Trinitys behalf or become a victim of what they're doing.

What's the legitimacy for using force to stop someone digging up a lawn that the owner is allowing to happen?

Playing right into their hands if you do....

...anyone whom he has reasonable grounds for suspecting to be about to commit an offence;
No need for the owner to have to stop them, allowing it happen is not the same as consenting.

At some of the rates I've been quoted for contract gardening, it bloody should be.

In fact, thinking about it...."Oi - you XR lot. I've got half an acre of woodland down here just covered in capitalist undergrowth that I'd really, really hate to see cleared, and I just love BP. So come down here and do your worst".

I'd imagine it's gone down like this.

XR arrive, start digging.

Police turn up "do you want us to arrest them for criminal damage, you'll need to make a complaint"

Trinity: "No, let them carry on"

...sit back and watch the outrage unfold.

I wonder how a protestor might react if some vandal knew their address and went round and dug up their front lawn?

I'd imagine the actions of the protestors digging up the lawn has caused unnecessary pollution. They've added costs to the Uni that could have been spent on education, wasted Police funds. I see them as hypocritical thugs.
Can't imagine the apoplexy it would cause if someone went round to their place and hammered real MEAT frozen sausages into their lawn.

Any takers?

May be the police asked if the Highways agency minded that the protestors were blocking the road....

Digging stuff up without warning, pointlessly blocking roads and generally annoying the tits off everybody. Who does that describe?

The later update does now mention that "a crime has been recorded for criminal damage."

Sounds like a lot of the colleges have now (belatedly) closed their entrance doors for the week.

I suspect they may also have thought "The College is richer than Creosus, we can get that lawn relaid tomorrow. And the day after that, and the day after that, and the day after that....."

I'd recommend when they relay the lawn they give consideration to installing pop up sprinklers....

Good, I'm glad they've seen sense. Be interesting to see how the offenders are dealt with now.
