I hear/read this a lot. "Why didn't he testify?"

But frankly, although it would have been the right thing to do, it would have made absolutely no difference, the Senate would simply have ignored it, possibly even blocked it somehow. At least this way he has dealt a genuine blow to Trump and reduced his chances of reelection. Ideally I would rather that he had done it in a couple of months time. I'm genuinely worried that by November Covid will be a distant memory, Bolton's book will have been forgotten and about a week before the election someone in the FBI will announce they are reopening an investigation into Biden.......

If my reading is correct, only the President can sack Berman, based on a 1979 legal opinion. However, it is a little more murky as his confirmation of appointment was court appointed, which makes it less clear.

One thing is clear, the Attorney General cannot fire a court appointed Attorney. so Barr, is clearly ultra vires.

Disappointing that Berman didn't take a leaf out of McConnell's big book of 'doing what the hell you like' and refuse to leave; forcing a legal show-down would at least clarify exactly what's going on here, a slow-acting coup.

I’d imagine the torrent of abuse and death threats from Trumps rabid fkwits may not be too desireable for most. They’d come no doubt if he didn’t go.
