BMW Warranty - Wear & Tear

My car sounds like a boat moving off after its been sitting overnight, so I took it to BMW to get it checked along with a few other things.
They said they can't spot anything but separate to that the brake reaction bushes are worn and are not covered by warranty.
Car is on 67k.
I have the comp warranty and the policy states:
Comprehensive Insured Warranty covers your BMW's mechanical and electrical components for defects that may arise - with the exception of those items specified below:
Batteries, all exhaust components (except Catalytic Converter), brake and clutch facings, discs and drums, bulbs and fuses, channels and guides, weather strips and seals, handles, hinges and check straps, trim, upholstery and cosmetic finishes, wheels and tyres, wiper blades and arms, glass, auxiliary drive belts, coolant and fuel hoses, the cleaning or adjustment of any component, all service items which will require periodic replacement. However all insured components, even if the failure is due to normal degradation (wear and tear), are included up to 100,000 miles from date of registration
Are they as I suspect just chancing it and trying to get out of replacing the bits?
Furthermore as they can't figure out what the creaking is, anyone have any idea what it could be? its an e93 335i, 2007.

Simple solution, as I do, contact the Insured Warranty team , they're great and will confirm and if necessary take your side.
Maybe 'worn' means not broken, not failed, so not a warranty claim...but if sir would like to hand over his own cash we can do it for him.

I had occasion to use a dealer close to Brentford when my NSF caliper stuck on the M40 on my way from Liverpool to the office.
I called BMW Assist who said I could wait at the roadside for them to tow me (could be a few hours at peak time), or I could drive to the nearest dealer.
I was only about 12 miles away from work, so thought I'd drive to the dealer closest to the office, so I could drop the car off, get it fixed under warranty, and just walk to the office.
About 2 days later, I was called to say the caliper had been replaced, and I had a bill for some of the work - as BMW Warranty would only pay for the part of the caliper that had been replaced, and the discs & pads that had to be replaced at the same time were consequential claims and not covered - FFS!
Negotiated it to only paying for the O/S disc/pad and they'd 'work something out' with the Mondial for the N/S parts...and arranged to pick it up at the end of the week for my return leg up north.
They then pointed out that during their 'courtesy inspection' they'd noticed my rear tyres were worn to a bald/illegal level (which is not outside the realms of possibility on the inside edges due to the negative camber), and when they told me how much to replace them I was surprised as it was only about £10 more than the online retailers.
Was about to tell them to go ahead, when a little twinge of the eye made me ask whether that was for the pair..."Oh no sir, that's each, plus fitting. Total cost £800+vat.".
Searched some new SuperSports out online and found a pair, available locally that afternoon for £320 fitted.
Went to pick the car up before driving it carefully about a mile to the tyre fitter. After about 5 minutes the fitter came over and asked whether it was front or rear!? I assumed it would be easy to tell, so thought maybe I'd ordered fronts instead of rears!!!
No, it was all fine, except the rears has 3-4mm on them, and the only 'bald' spots were on the outside edge where the PSS has a very shallow tread that disappears into the shoulder!
Got them fitted anyway, as they'd been ordered & paid for - and took the two removed tyres back to the dealer near Brentford for an explanation. Their excuse was that they recommend replacing them at 3mm and mine were below that when measured - and they meant 'bald' as in 'below our recommended minimum'.

I think this just goes to show the different experiences you can have. I had a rear sticky caliper and they replaced the caliper and both discs and pads under mondial warranty. Not sure if it helped that the disks and pads had been replaced 2 years prior by bmw and showed in the service book. but I didn't pay a pennyI had plenty of that rubbish when I took my M5 or Z4M into dealers for warranty work.
