Well, yes. This bit of law isn't complex, isn't obscure, isn't new and the defendant's legal team definitely would not have needed to trawl a library to find it.

It comes down to that often quoted legal term "Mens rea" , although other terms are available.

Intent in other words. The law surrounding the offence of murder can be complex and other aspects can come into it but that is not relevant here.

I'm guessing a lot of people posting have never served on a jury

You are reminded again and again by the judge and the legals "beyond a reasonable doubt"

Its actually a really high bar as a human to sit and listen to the evidence, knowing your decision will determine the outcome of the rest of someone's life, without reasonable doubt

They knew he killed her, they had to determine "beyond a reasonable doubt" whether that was his intent at the time

I know in the case I sat on the guy was looking at 5-10 years and the register for the rest of his life and that weighed on us, happily it was the biggest crock of st that should have never gone to court and he was NG within 15 mins of us hitting the room
