I'd say it's more likely that the pressure group wanted publicity to sue and needed a Mexican to persue their chosen avenue. She's merely the first one they found that would help.

A member of staff in one of my fellow managers sections is a Mexican and normally a jovial chap we had a joke with him about it and to our surprise he didnt see the funny side of it all,perhaps it is something they are a bit touchy about?

About the same as the Uk, Greek, Italian, Spanish, Portuguese.. et al.... economies..

Your point being?

The Mexicans are California serf labour..

To me the joke is a pretty dated one that wasn't really that funny, but appeals to a broad amount of people who love stereotypes..

Like the Hyundai dog thing that clarkson did at the Motor show back in 1990's (I was there in the audience).

Like, restoring Law & Order in their country, which is currently in a state of war (pretty much) between rivalling drug cartels!

Wasn't funny, but legal action? Ridiculous. Whilst I'm happy every time Clarkson comes unstuck (I still root for Eric Bana to hit him every time I watch 'Love The Beast', when he tells Bana, "All muscle cars are crap") the idea of taking legal action against someone for a joke is madness.
