She's played that wrong. She should have let them suspend her. I suspect she'd have had an easier lawsuit then.
If they are basing it on her having pictures on her profile of her doing things it is illegal for her students to do, then that's a whole can of worms open. (Not to mention the issue of jurisdiction, with a lot of the USA still having laws that make it illegal to drink until 21.)
As well as the obvious point of smoking, there will be anything related to age restrictions. Would she be allowed to have pictures of her driving? What about filling up a car with fuel?
I think it's a bit silly for anyone in that kind of a role having an "open" Facebook account that students can look at. It's quite obvious that she shouldn't have students as friends, and the profile should be invite only.
Now that the case is moving on, it might be interesting to find out where it goes, and see if common sense prevails at any stage.
