I'm still waiting for the P45 to be received but hopefully I will receive it in the next week or so.. also in the meantime I've been down the job centre and have signed on from the 1st of the month so It should be on record that the contract has finished with the HMRC.

Also my contract end date was actually on the 12th Dec which was the official end date but was extended on a daily basis afterwards but I do have all my wage slips if the HMRC need to have look at a later date.

I thought it was standard to keep all paper copies for 6 years anyway, or at least my accounant states that but Im not under the control of an umbrella company.
It is correct to hold on to documentation IF you are are using the data from those documents to -

a) compile accounting and financial records

b) using the data to make claims against your or your own company's tax liabilities

If you are running your own business, it makes sense and is indeed a legal requirement to retain such information for AT LEAST six year. In reality, the retention period is often longer (depending on financial year end dates and HMRC tax enquiry or fraud investigation windows).

If you are an employee, then there is less onus on record retention.

Get that P45 as soon as you can. If anyone is in breach of regulations it is your former employer as they should really have let you have the P45 LONG before now (preferably the day you formally left that employment).

You have not ended your "contract with HMRC" as you don't have a "contract" with HMRC.
