Can't be your fault can it?
Ignoring the post that came through from the courts informing you of court dates etc etc can't have anything at all to do with you getting a CCJ can it?

The CCJ was granted automatically.

I used to blame the banks entirely for my situation but now i atleast shoulder some of the responisibility in that I blame myself for allowing the bank to do it to me.

I was getting up to £300 a month in bank charges at the peak, for a debt that was 95% bank charges.

I was furious, i heard nothing about any court date until i got notification of the CCJ, the bank had been cashing the monthly cheques i had been sending them, but they started paying them to someone elses account or something. I had to send them my bank statements before they would even look into it!

I then had to borrow the value of that judgement to pay the CCJ off within a month to get it 'annulled'.

There probably was a way to sue the bank, or their debt collection people, or their solicitors but i want them out of my life.

Is this possible - don't they have to write to you saying they are taking the matter to court and giving you the chance to defend the claim if you wish?

Well nowadays the courts write to you and give you chance to respond.

Ill bet. Exactly the same thing happened to a friend of mine where the bank 'lost' his payments in the same way and he got a CCJ. The only difference was he was stupid about it and knew of the court date but forgot so didn't turn up.
Anyway he's dead now so it doesnt matter.

Right, i feel a little annoyed that everyone assumes only pikeys and chavs use these services, I have a nice car, live in an 18th Century Bungalow (1 acre of land) on a part of the Crown Estate and without them i wouldn't have been able to survive the first 6 months of the year.
I earn a good amount and have hardly ever used credit, so therefore have a rubbish credit history, it is in total 2 sofas, an overdraft for £200, and mobile phone contracts. So when i phone my bank asking them to help me with a short term extension after a very hard year they say i don't have a good enough credit score. Now you as this is PH i'm expecting you all to say it's my fault for going over my overdraft a few times and the like. Last year my OH was seriously injured we went from a combined income of over 50K complete with her debts being paid off to just my wages £30k+, the vital outgoings for our house/cars/bills and living ate up everything we had and when she finally went to work i had nothing from savings and was over my overdraft every month just to survive (before you ask i earn to much for us to have qualified for anything more than her sick pay and she was off work for 6 months so not long enough for her to get anything to help).
When in Jan her car broke we just managed to cope, then the vets bills for the cat in Feb arrived along with my car having an ECU problem and her needing new rears and the MOT's for both cars we had nothing, no one would help and in desperation i called one of theses companies. All i needed was £300 my bank had refused me, and i got it in less than 5 hours. Enough to keep my head above water. I have used them a few times since it costs less than blowing over my overdraft and they are nicer to deal with than my bank.
Seriously, yes if you look at the yearly repayment then it is nuts, but next month if something happens that i can't afford to deal with i just call them and know that i have it sorted. I don't want to, i never want to borrow money, but i would rather have it for a month and pay back then have £10k sitting over my head for the next 3 years.
