I'm not aware that the PWetcA allows you to remove a PW and then build a new wall solely on your neighbour's land to your specification without their approval or permission.

My sister just text that the council didn't bother to reply to her previous phone call. She's back from
Working away this evening, so tomorrow she will go to the council offices then to the solicitor if nessasary.

tbh if she doesn't care/act quickly enough then she won't have a choice.

she should be phoning constantly, not waiting until tomorrow.

also has she talked to the neighbour again about the wall yet?

My sister and brother in law went to see the neighbour late last night, all is now good the wall stays and they are building inside there boundary, also it's agreed that they will back fill under the party wall if they find no foundations. My sister and i thanks you all for your help.

Sounds good.
The neighbours should still follow the PWetcA as much as possible.
FWIW the backfilling that you refer to is called underpinning and they are allowed to put half of that (usually a min 600mm wide, 300mm on each side of the PW line) on your land.
Sounds like they may have saved neighbourly relations.

Should definitely put a stop to the work and get a Party Wall surveyor involved - neighbours have to pay. What if they damage your sisters foundations in the building process?
