After a bit of advise regarding water damage to a ceiling

I had a water leak about 2 years ago, the pipe off of the bath overflow popped off at high level and when the bath was emptied some water went up the pipe and leaked onto the ceiling below.

At the time it dripped through the light fitting in the room below and left no stain etc, 2 years later a small section of the lath and plaster fell off.

The person who owns the down stairs flat is saying it's 100% caused by the previous leak, I spoke to a builder who didn't seam to think there was any chance that moisture in the plaster could have been there for that length of time.

If replaced a fair about of the old lath and plaster in my flat as it does seam to be coming to the end of it's life, expect
It was installed in the 40's or 50's

Really just after an opinion on if people think the leak would have cause the issue as I don't tend to trust a single word the person tells me about anything (we've had lots of issues over the years)

So it damaged the ceiling of the flat below?

You're not in anyway liable unless you were negligent. If what happened was as you describe then the downstairs owner has to repair their own damage, or claim on their insurance.

At the time there was no damage, but could damage 2 years later have been caused by the leak? At the time I offered to have it repaired and painted if there was a issue after it had had a chance to dry but there wasn't any marks to repair

She did try the insurance but they're not interested due to the length of time.

My gut feeling is that she'd just like anyone else to pay to maintain her house, we did have some discussions about what she was spending the maintenance fund on when she looked after the management company accounts hence the lack of trust.

I don't think anyone can say with any certainty that the leak caused a weakness that is only showing now. This may be more about future relations with your neighbour. If you refuse point blank then there will probably be bad feeling. Can you afford a without prejudice offer of something towards the cost? A complete new ceiling cannot be too much surely?
