Land on front of house

I was wondering if anyone could shed some advice on this for me.

The front garden on my house goes directly onto a road. Looking at the boundaries on the deeds, we only own about half, the other half being the highways agencies. (Approx. 4, the same width as our garden)

From looking at it, you would think it does actually belong to our house.

About 6 months ago, we put a fence all the way round. Only a small post and rail for the main purpose of keeping the kids safe. Since then, our neighbour has had the council round to cut a tree down in front of her house, and this has now flagged up to the council about the fence.

Speaking with the council, they said that we can try and find out who actually owns the land and If it is registered to anyone. We could potentially apply to extinguish the highway rights and keep the fence. There would be some associated costs with this but this is a bit of an unknown.

We have mowed the grass on this for the last 2 years with no sign of the council, and the previous owners (friends of the family did this for 10 years).

Would anyone be able to help on where we stand with this or what we could potentially do? The neighbours are all happy with the fence as we checked this prior to putting it in. Like I said previously, the main reason is for the kids safety + its a nice place for them to play.

Any help would be appreciated on this.
