The obvious answer is always the best one wink

The basic rules are that you need planning UNLESS:

- the structure is more than 5 metres from your house, AND
- it is not between your house and the road, AND
- it is less than 4 metres (pitched roof) or 3 metres (flat root) high

Rule of thumb - shed in back garden = OK, garage on driveway = needs planning.

In any case - talk to your local office and get the real facts!
Just to let you know that Permitted Development Rights were amended in October 2008... the suggestion of using the planning portal is probably the best start & then speak to your planning department.

Although bear in mind that I have recently come across various local authority responses to the changes. Ranging from;
- it is up to you to decide if it needs planning permission
- we won't decide therefore it is upto you to make a Lawful Development Certificate application
- we will charge you to discuss the matter and give advice
- write in with the details of your proposal and we will respond if we agree with it

Also, different authorities have decided on different interpretation of the changes to the Permitted Development Rights. The idea of the changes was to streamline the process of planning permission (yeah right!) as 'generally' a domestic extension will incur a fee of £150 and basically they can't make it pay... so, change the regs to make it simpler... sounds an excellent idea UNTIL one council decides that they don't want to make the decisions and ask for a Certificate of Lawfulness application, which costs... wait for it...


£75..!!!

So, basically a similar level of time & effort for half the income!!!
