Quail is still in my garden if you fancy it.
Sorry guys but "Quail" my ass!
Its definately a Partridge, not any species of Quail at all but most likely either a young Red Legged or French Partridge.
Both these species are commonly kept by Gamekeepers and released for shooting.
You did the right thing in letting it go again as it doesn't appear to be injured (from what I can see from the pic)and neither the RSPCA or RSPB will show any interest in this case anyway.

If you look at the markings on the face of the bird in question they match exactly to the image of the Red legged you posted below. I did say a young one so hence the colour difference.
