Fact Findings are most definitely biased. If the ex wife is putting on an act and getting upset, it's game over.

I commented to the Bench in my hearing that they have already made up their mind and there's no point in continuing. The Bench conferred with their Legal Adviser who advised them they ought to continue!

Got one quote so far for a direct access barrister, roughly £5k. Total waste of money (to go with the rest of the money wasted).

Anyone have any recommendations? I have used 2 different direct access barristers, 1 was good but perhaps not vicious enough, 1 was 'I know best' and was rubbish.

Most recent hearing I represented myself, the Judge without me even speaking asked why I had no counsel as she felt it was so awfully complicated I was wrong to be on my own.

I resisted saying "yes, I accept I do not know all the family law procedures, but I am extremely intelligent, and my ex-wife's solicitor is an idiot so I am confident it will be fine". Neither direct access barristers I had did much more than repeat what I told them to say! The hearing went fine, I stood up for myself.

Anyone have any recommendations for a lawyer/barrister for the Fact Finding? Someone who can handle the opposition being dirty (bottom feeder of a solicitor) as a lot of the legal people are very naive and middle class privileged, who are not equipped to deal with underhand moves from the streetwise opposition.

Also should I hold things back for the cross-examination, or put everything into the statement with the Schedule Of Allegations.

Ask yourself what's at stake in the hearing. Personally, I decided spending £5k at a fact hearing wasn't worthwhile because the only thing at stake was whether I would be allowed to return to the matrimonial home or not. Ask yourself what you could lose or gain and decide if it's worth spending the money.

I knew my fact finding hearing would have no effects on the child arrangements or financial hearings. There was no concerns raised that would had any impacts on these matters. My ex simply raised allegations of domestic abuse simply to kick me out of the house.

I prioritised my money for the child arrangements and financial hearings.

What do got mean by child arrangements? My understanding is that you have the fact finding and then a final hearing?with cafcass in between.

Ah sorry. I only had a Fact Hearing for an Occupation Order as I wanted to return to my matrimonial home.

I don't think I had one for the child arrangements order. I could be wrong but I'm sure I just had the First Hearing, then Cafcass were instructed to do a report, and then I had the Final Hearing.

Cafcass were extremely poor though. My ex admitted to ill treating the kids but gave her a pat on the back for admitting to her transgressions. My kids told cafcass they wanted to see both their mum and I equally. Cafcass noted this and did not put this in their recommendations. And the Judge did not like my barrister and I arguing against cafcass recommendations. The judge said cafcass are the experts. I told the judge that was ridiculous that he believed cafcass were better qualified than I with regards to my kids.

The Judge finally relented and awarded me 50/50 but it was a hard fought battle. I even managed to get it in the Order that the kids "live with" both my ex and myself. This prevents one parent having the sole rights in regards to the kids education, where they live etc.

If your fact finding is regarding access rights, yes I would advise on securing a barrister. Might be worthwhile asking Tonker if he has any recommendations?

Good luck with it. It's a part of my life that I'm glad is over.

Quite a few posters have taken against my comments, basically saying good for him, who doesn't want a much younger woman, I'm being cynical, etc. Which kind of explains why so many are on this thread moaning about the breakdown of their relationships. Because they put their knobs before their brains.

If you look at his previous relationships you can clearly see that he must have something other than money and looks that attracts beautiful women , probably says more about people that frequent motoring forums have very little to offer the opposite sex other than money
