Its one of those bizarre quirks of referring in football - both players put a foot dangerously high but the one that comes away with the ball is always penalised. There is no rational for it that I can see!

Deliberate is defined as hand towards the ball. Standing with your arms outstretched in prediction of where the ball might go isn't hand to ball.

Given the guidelines are I suspect very summarised and the officials work off of more detailed descriptions, by holding your hands out in an unnatural position with the intent that you will block the progress of the ball will be classed as deliberate.
