Yeah section 75 is what this guy needs to claim under but at the end of the day the cc company are in the right not to refund his money and if it came to getting the ombudsman involved the bank would still fight it as mastercards rulings favour the bank in circumstances like this. I work in chargebacks but for a different back and have done so for many years and this isn't the way to get your money back. Small claims would be where we send him

So it's been a while since this whole sorry state of affairs began, however in recent days, things have quickened in pace.

As you all may recall, I was also in correspondence with people on the Fight Back Forum 'Pepipoo'.

Well, someone I had been speaking to on there got back in touch with me last week asking if I'd had any luck.
I informed him that I'd given up and he urged me to reconsider. He emailed me copies of forms he had written up for a couple of other people who had suffered similar fates as me.

Since then we have been emailing back & forth, making amendments to both the N1 Form & PoC Form, making them as specific to my case as possible.

I think the forms are almost ready to be sent to all parties involved. We're initially going to send the forms to them to see if one, or all, will be prepared to settle outside of court. If they refuse, we'll be going to court.

They need a balls of steel sort of thing where they wait till the tow truck arrives, then they clamp the tow truck. The tow truck would have been parked and as the signs say, clampers operate in the area. Charge them a fee of £200 to remove the clamp from their truck.

One needs to be registered with the SIA before one can clamp and charge for release frown . Also need to do it before October wink .

However, if the intention is to clamp and NOT charge for release at a later date yet to be specified wink then one should be OK without an SIA Card (before October anyway) smile .
