You're better off asking the Police that yourself as I'm not qualified to answer.

The legal definition of theft is the removal of a persons property without any intension of returning it. So as you have your car back it isn't theft. You car has been held to ransome though. If they refuse to give you your money back then it is that which has been stolen and as it's less than £1000 I think it could be passed as a civil matter (especially in Essex wink ).
I haven't got my car back yet though...

In that case report it stolen and give the Police all the details you have.

You lot are hilarious this evening:

Report it to the Police!
rofl It's hard to imagine something they would care less about - "nothing to do with us, sir, it's a civil matter".

Pay by credit card and then claim it back:
Do you seriously think the clamping company would take payment by credit card is this was possible?

Send the clamping company snaps of the area & signs and ask for a refund:
Like that's gonna happen.

I've just spoken to the Police who have noted it down on record and given me a reference number. They do say it looks like more of a civil matter however the fact that I now have a Ref could help if things don't work out on Monday when I try and get the car back...

I really hope my car is safe and in one piece.

I'm gutted this has happened, it's completely ruined my weekend and my car is now locked up almost 20miles away in a dodgy looking area with less than satisfactory security... The whole thing comes across as a well oiled sting, and they are going to screw you for every penny you have.

Can anyone tell me where I stand in this situation or give me any advice on what to do now?
Bring a couple of mates, retrieve the car and claim ignorance afterwards smile

ETA or not, seeing as I've just noticed the previous post.

Security consists of two sets of gates (padlocked), CCTV notices (although I didn't see any cameras) and a bloody big rottweiler guard dog...

It's the dog that puts me off.

Take loads of beef/chicken/pedigree chum with sleeping tablets in. Dog will get fat and full and sleep. Or maybe die. But even as a dog lover. Collateral is acceptable. And may demonstrate how serious you are biggrin

I haven't got a serious suggestion other than approaching the company that employed them and explaining how they moght not like their companies good reputation dragged through the national tabloids.

This is the first time I've ever experienced anything like this. I didn't know quite what to do.

Also, there were three guys standing really close to my car and my car was locked. By the time it would have taken to unlock it, open the door and get in the car, I imagine I'd have been jumped and bundled as far away from the car as possible.

I'm not exactly the biggest of guys, and it wouldn't have been too difficult for three blokes to overpower me.
I'd be surprised if they even tried to touch you, if they had then I would imagine you could have grounds to pursue police action. These guys are only after a qucik couple of hundred, they don't want police attention.

On WatchDog they clamped a clampers car - he immediately called the Police and said the (TV) people were getting violent. I don't theink they turned up though. Reports say when they do turn up they take the clampers side anyway.

There's an article in The Sunday Times today about clampers and implies that they have to wait a minimum 15 mins before they can clamp you. One company is being accused of doctoring the time on the photos to show that cars were there for 15 mins when they weren't.

If you were really only there for a couple of minutes it might be worth asking to see any evidence they have.

I hope it works out for you mate, seems like a rough deal. They cant take the car if you have a sign in it saying "live animals on board/wild badger in boot/rare noctunal one eye trouser snake" etc...something to remember for next time.

I had a run in with these scum bags a few years ago. Long story short. I'm diabetic and stopped in services for a rest. I fell asleep at wheel of van. Woken up by clampers as I had exceeded 2 hour limit. By time awake they were gone. I was slipping into diabetic coma but managed to phone number. Clampers came and were extremely rude and unpleasant. I showed them my medical card which proved I was diabetic and asked them to help. They demanded £180 first. Then they laughed and drove off after releasing clamp.
Eventually, I got my money back and the clamper sacked!

Unless they have a licenced dog handler it's just a dangerous dog and if it tries to bite you, you can have it put down.

Personally I report the dog is mistreated (ie left outside all hours with no supervision or adequate food water etc) to the RSPCA. wink

Get the car back and claim for damage to your suspension, tyres, wheels, wheel bearings, etc where the car was moved, totaling at least £500. hehe

Well, tomorrow is D-Day. Hopefully all will go smoothly & I'll get my car back.

I can then look to getting a chargeback issued from my CC Company...

Wish me luck...!
