To our surprise, the police (who really weren't interested) declared it was the truck driver's fault for not leaving enough room when passing the parked car.
It honestly wouldn't have been possible for our truck to pass the car without being in striking distance of the car's door.
Doesn't seem right to me, but that's what happened.
Take everthing the police say with a pinch of salt. When i wrote my first car off when learning 10years ago the attending police were adament it was my fault.
Not what the insurance decided though was it smile

I did this when I was a young teen and I was on a pushbike. Bloke opened his door, I hit the inside, went clean over the door.

Bike was fine, I was fine, amazingly his door was fine, didn't even bend back, which I was surprised about.

Normally would have been the car driver's fault - except I was careering along a pavement biggrin

He looked more shocked than I was, so I picked up the bike and buggered off a bit sharpish...

What if the passengers door is open say 2-3 inches. Outside a school area. And a driver is trying to squeeze his car pass and breaks his wing mirror and scratches his drivers door.

My car was parked with the passenger side on the road. Door was already open. And the third party tried squeezing past, and must have had a bit of speed on him as he hit my car. Insurance say its likely to be my fault. Can I defend myself.

I've had near misses with this a couple of times on the bike. Did find myself wondering what the legal implications would be if it happened... now I know.

Didn't the highway code used to have a section about always leaving a "doors width" between yourself and a parked car?

Either way, I'll be interested in how this pans out

bloke I know, his (rear) passenger did this with a tram, ripped the door clean off, the day before he was due to drive back to UK, he gaffa taped it back on biggrin

As happened to me back in 2001 when a door got opened (by a passenger) while I was filtering. I got my brand new R1 fixed, lady in brand new Clio got her car fixed, passenger who opened car door got nicked.

Situations like this can always be put down to one of three things.

1. Arrogance
2. Ignorance
3. Stupidity

Or all of the above.

The same goes for any other act of careless behaviour on the road.

If you open your car door into the path of another vehicle, you are a fking moron, end of story.

Believe it or not, there are people out there who will open a car door onto a busy road purely because they believe it is their right to do with the onus on you to avoid them.

Go figure.
