my 5 year old son has autism and loves to ride "up front with mummy" when ever he can. We have a disco, and loves to see over all the cars. However one of these community not real Bobby's pulled her up to day and told her she was breaking the law. a child has to be 13 to sit in the front seat. Now my son is 5 and 112cm tall. When he is in the front he is always in his booster seat. I know some people frown at children being in the front, but i never thought this was illegal. Have i misunderstood the law here. Have i and my wife been law breakers.

So if you had an MX5, where would you put the child?

It is legal otherwise how would you ever transport a child in a two seater?

However, technically the rear is the safest place to be. If you have an airbag, it should either be switched off manually or automatically de-activated via seat sensors.

Indeed. My daughter traveled in my MX5 from a baby to 4 years until I sold.

It is illegal to have a child in a rear facing child seat in the front passenger seat if there is an airbag. Otherwise, kids can go up front. So you are fine.

Interestingly, in some circumstances it looks as though the child MUST be in the front, presumably because it's safer belted in the front than unbelted in the rear.

s.3A Road traffic Act 1988

You must not drive a car on the road if,

(a) a child under 12 years old and less than 150 centimetres high is in the back seat,
(b) there is no seat belt in the back seat, and
(c) the front passenger seat has a seat belt but is unoccupied.

You should not use a rear facing child seat in the front, due to incidences of airbags deploying in a crash and causing death or severe injury to children in them.

This doesn't sound right, surely you just need to switch the airbag off?

No, don't think its illegal, hope not as our two year old gets transported all over in my Elise next to me in her child seat (she loves it, royal waves to anyone and everyone on the pavement)

Which is why lots of cars enable you to disable the passenger airbag...

if front facing, you should have the seat as far back as possible, away from the airbag

I'm assuming you only need to turn the airbag off otherwise why would there be a switch for this and the relevant warning stickers plastered over most modern cars? Besides surely the front seat as far back on the runners so central in the car and behind the b post must be safer than right up against the back of the car.
