Non Fault Accident - Sold Car Prior To Repair

All,

I was involved in a non fault accident a few months ago whereby the third party rear ended me. It has taken some time to resolve (until now) as I couldn't afford to set aside my excess and the inaction of an AMC. My nominated body shop (main dealer) have called me to say that the repairs have been authorised and have called to get me booked in (The insurance assessor viewed the car a week after the accident and authorised the repairs).

However due to personal circumstances I have had to sell the car (with damage) at a reduced price on account of the damage (The car was listed for sale at the time of accident). My personal circumstances necessitated the sale, if I could have kept the car I would have done.

Now I am out of pocket due to the actions of the third party (couple of £k whist the repair estimate was about the same amount and which didn't include any additional damage that may be discovered).

In a previous accident I was given a cheque to pay for the repairs diectly with the bodyshop, and I was expecting the same this time to offset the lower sales price (I'm still under the same insurance policy in the same year currently, think captain of a ship) but don't know who the third party is insured with.

Before I call up my insurance company to see what the situation is regarding this I am wanting to know what I can expect?

Wow that's a complex one?

So pressumably your insurance policy still exists and your claim still stands despite no longer being the registered keeper of the car?

Personally I've no idea what I'd do in your situation, but did you not think to call your insurer before selling the car to see what the process might have been?

You should be able to get cash in lieu, my wife had similar happen to her - albeit in her case it was second accident rather than opting to sell the car. The 2nd accident (her fault) was enough to write off her car and claim went through swiftly, but 1st accident took longer to resolve (3rd party fault but silly fool put up a fight, even though my wife was stationary in a car park queue and he reversed out of apace into her)...anyway by the time it was paid out there was no more car to repair, so we just got a cheque to the value of the repair estimate. Quite a bonus as it happened.

You may need to get authorisation to use your choice of repair centre, eg at your local body shop, you will need a lower estimate, and then once the repairs are 'completed' you will need an invoice to show you 'paid' for the repairs. good luck.

Thankfully this has already been authorised based on the body-shop calling me to say that everything had been sorted and to get me booked in and the assessor approved the works required back in June

This is my hope, after a minor accident on xmas eve 2011 (when I still had the car) I got a cheque for £7k to cover the repair estimate and got the car repaired after funds had cleared without even requesting it
