Ended up costing me £800 in costs I could not claim back.

This is something that seriously pisses me off about this breach of the peace st. I had a similar situation to yours where I was provoked into reacting. It was a simple case of someone shouting at a family member of mine for no reason but own sick pleasure so I decided to stick up for them and swear quite intensely, notified them I would like to kill them in the heat of the moment and that I would shove his head up his mums ass if he ever did anything of the sort again.

Needless to say I thought nothing of it after this however I have police round at my door saying it was "breach of the peace" I actually laughed and said I can see where your time is wasted now - It was a simple argument and by looking at the whole picture you would see that. it was only a heated argument.

Went to court - it got thrown out as it was my first offence but it would stay on a hidden database if required.

Would this stop me from doing it again - NO it wouldn't I will not turn into a puppet of society just because it won't let me defend what is wrong and right. Maybe if the police done a better job we would all be in a better place; rapists wouldn't be free on the street, elderly people wouldnt be robbed, kids wouldnt be hurt and we would be in a safer place all round.

Did you get a solicitor, you need one as they will push for you to meet the kid and shake hands on it rather than this going to CPS, who will want it in court.

Stones? Blimey, I salute you for having the courage to do something about this. Kids or not if the stone shatters a windscreen it could cause a major accident. I know I'm getting old but back in the days you'll definitely get a well deserved smack for this.

I'm not being absurd, and having just been through this myself I was gutted to find out this could have been agreed if I had had my solicitor with me when I was arrested.

In respect of summary only offences, these no longer pass through the CPS, save for domestic violence and hate crime but many out of court diversions do. The CPS do not want everything in court, take it from me. I should know. wink

So why did CPS want my case to go through court???

And why, when, I got "not guilty on all charges" did it still cost me nearly a grand??

A couple of years ago i posted a similar story only the stones were being thrown at my house and it ended with me pinning the scrote to the floor with both his arms up his back in a way that arms were not designed for wink

Several PHers predicted i would be in all sorts of trouble and that i should see a legal type. They were wrong.

I do know where the little scumbag lives now. I make it my business to pass the house 2 or 3 times a week in a rather obvious manner wink

Good on you OP, but i wouldn't want some scruffy little oik in the back of my car. Have you had it fumigated?

I've had stuff chucked at my car before, found a screech of brakes and the sight of the reversing lights coming on usually enough to scare the offenders off! On a lighter note during a summers day I was driving in town with my window down. A group of kids ahead were throwing water balloons at passing cars. Unfortunately my electric window didn't go up in time for the next balloon. Water over me, the dashboard, door pocket and the burst balloon ended up on the back seat. Livid I drove round the block and pulled up silently beside the watery assassin. The look on his face was priceless as I proceeded to give him a telling off. Don't think he threw any other water balloons that day.

It depends on a couple of things, the lads themselves, the parents and the police officer that deals with it.

If the lad thinks "st I deserved that!!" that is the end of it.
If he goes running to his parents they may say "You twot you deserved that!" or they may say "Right, let's make a complaint!!"

The copper dealing with it may do everything by the book and arrested you, take your side of the story and his and then send it on to CPS and they will decide whether to proceed.
However, he may be a bit more old school, take you round the lads house and get you both to talk to each other.

I guess it also depends on the area, in a high crime area the police may just say to the kid "You twot you deserved that, if I see you again I will nick you." in a sleepy little town this may be the most exciting thing to happen in weeks.
