Seems to me that if you are going to do that, the top wheels at the back should be be touching both sets of lower wheels.

No they would lock up as the lower wheels would be driven in different directions

hehe Although having just blown the pic up to full size, it looks like the vent's one of the non functional / self adhesive stick on pad jobbies. Even better hehe

But the with the top wheel touching the two bottom ones in a piramid formation (ie top wheel in the top-middle position) the two lower wheels will be forcing the top wheel in two different directions.

Why not?

If the two rear wheels were in contact with each other,as well as the road it wouldn't work, with or without the top wheel, but with a gap between them, as in the photo, it works just like your diagram shows.

If the two rear wheels were in contact with each other,as well as the road it wouldn't work, with or without the top wheel, but with a gap between them, as in the photo, it works just like your diagram shows.
Arr yes - sorry - assuming one of the lower wheels is the driven wheel (which it is here) at a brief glance I thought we were talking about the top wheel being the driven wheel - which would have explained why only one of the lower wheels is in contact with the top wheel.

It doesn't matter which wheels are driven so long as all three don't touch. ie wheel A can touch either B or C but not both, B can touch both A and C but C can touch only A or B but not both.

Which is why, when I made my original comment I suggested that the top set of wheels should be touching the bottom two sets and not that the bottom two sets should be touching each other.
