need some advice ,
i was working for a courier company and i filled up with diesel £95 at a garage my boss told me would accept the fuel card , it was my last day of employment as well so on my way back to the depot i fuelled up then found out my card wasnt good at the garage , i didnt know my bosses address as he was a sub contractor working for the ourier ompany , so i put my own name , he hasnt paid the bill and says he is not going to ??? , i received a letter from dept collectors saying they want payment , i am at present taking him to a tribunal as he also hasnt paid my wages or week in hand money and refuses still now after 4 weeks to pay up , any advice on what i should do would be great ,

Perhaps you could ask him for a new keyboard while you're at it? Trying to read that made my eyes go funny.

How did you pay for the fuel if you didn't use the fuel card? Who are these debt collectors working for?

Sureley this should all be wrapped up in the tribunal you're having, as it's just another cost on top of your wages.

in a nut shell i filled up a company van needing fuel , i left employment on the same day and now my boss wont pay the bill for the fuel , i handed over a fuel card at the garage he said would accept the card , but the garage didnt ? , so i had to fill a form in and i had to put my name on the form , he refuses to pay the bill leaving dept collectors chasing me for payment

i have since been in touch with acas and they say the tribunal wouldnt involve themselves with this matter ,
am soooooo frustrated ,

I would pay the bill with the garage for the fuel to save any unwanted credit rating going against you in future. I would talk again to the tribunal as its essentially unpaid expenses,
but if they are not interested could try the small claims court against your old boss, but they sound a dodgy piece of work, so good luck and be prepared to be messed around a lot.

if they wont deal with it at tribunal take him to small claims court.

No, no, no, you misunderstand. They collect departments. They have accounting, HR and sales so far. They just need R&D to complete the set.

Pay the debt collectors/garage to keep yourself clean. Then sue your previous employer using the Small Claims Court online service. https://www.moneyclaim.gov.uk/web/mcol/welcome

PS, I'd get someone who speaks and writes good English to help you fill in the form. I don't mean to be patronising or insulting, but it won't help your case if it's badly written and puctuated.

Why didn't you put the name of the company? What did it have to do with your boss if he was a sub-contractor?

If the van belongs to the company, surely that's who your claim is against, not your boss?

Your'e chasing the wrong person! If your ex-boss no longer works for the company then its not his responsibility to repay you the money... you need to be taking this up with the company.
