I would not think about whatever the owner may have done, it's too late to worry about that.

Also, I wouldn't get lawyers involved at the moment. Just because of the cost.

I would write to them, send it recorded delivery and set out what you want. Send a copy by email too and keep a copy. And make it clear legal action will be the next thing and put dates.

Something along the lines of:

Dear Sirs,

RE: Payment of £XX,XXX for the sale of Porsche Cayenne Reg AB00 XYZ

I am writing to you regarding payment of the amount of £XX,XXX due to me for the sale of the above car on the XX August 2015. Following my previous discussions with yourselves I have not received payment. I must therefor insist that the full outstanding balance be paid immediately to the bank details previously provided.

If full payment is not made by the XX September 2015 I will commence legal action. Costs and interest from the date of sale will be added.

If you do not have my bank account details on file please contact me on the details below and I will be happy to provide them, or alternatively I can arrange for a cheque to be collected from you.

Regards,
Name, address and phone number.

I would not get in to any discussions with them. Give them a maximum of 5 days to pay, possibly 48 hours if you can. Don't take any sob stories or any nonsense and if they call you just keep telling them politely that it's not your problem and you just want payment.

Steve, thanks. I have sent an email on this morning with this listed. I will send recorded by mail also.

I have someone in their offices waiting for the transfer if they fail to do this then I have made them aware that we will contact the police in the first instance if they do not transfer the money by mid day, I see very little option left and this is how I will progress from today. I will also start to have something drafted by the lawyers we use at work.

Too many stories to list them all. My guy has been there all day, cars everywhere. Taking some advise from the police.

One saving grace is that following the information you've just seen, if he pulls the same stunt he may be looking at a custodial. Avoiding that would be a reason to pay up.

That's what I am hoping, also with the amount of stock that is assembled is not just to ensnare one customer, the business looks to be a going concern with ambition to continue. Police as expected has reminded us this is a civil matter. This might have to be a waiting game with continual pressure to insist they pay as soon as he gets out of hospital (if he is even in hospital).

Not when you point out that the same peeps have just been convicted of fraud for doing the same caper. It may take some pressure to get th cops moving but this is not a civil matter if it was intentional and that doesn't sound hard to prove with their form.

If it wasn't paid for, it was stolen. So the 'buyer' will have the car taken away and returned to its owner?

If the OP agreed to let the place sell the car then its not been stolen. Legally all thats happened is the seller hasn't yet paid the OP.

I would imagine a high number of these types of businesses are all show with very little real money behind them
Hopefully it's just a cash flow issue, they probably need to sell a couple of cars before settling with you.
I'm guessing he will have picked you to hold out on because of your location, figuring it would be easier to fob you off for a while by phone and email rather than deal with an angry debtor face to face in the showroom.
Keep up the pressure mate, you might have to wait, but reckon they will pay up in time.
