Hopefully it's just a cash flow issue, they probably need to sell a couple of cars before settling with you.
I'm guessing he will have picked you to hold out on because of your location, figuring it would be easier to fob you off for a while by phone and email rather than deal with an angry debtor face to face in the showroom.
Keep up the pressure mate, you might have to wait, but reckon they will pay up in time.

I agree with most of what you have said, the company is a joke and the mistake engaging with them lies with me trying to sell the car in this manner, never again. After a significant amount of pressure and personal visit to their showroom they have agreed to transfer the balance on Wednesday. The lies being told to date is unbelievable and really starting to p*** me off. Until Wednesday we will keep up the pressure, if this comes and goes then we will pursue them legally as hard as possible and do everything possible to limit their trade.

DO NOT LEAVE YOUR CAR WITH ANY GARAGE ON SALE OR RETURN, NO MATTER HOW LONG THEY HAVE BEEN TRADING!

It could end in tears, and they will be yours.

Do it quickly too - if the company goes into administration you are nothing more than an unsecured creditor.

OP I don't know why your not there already, after reading what the director has been done for I'd be in there offices & not leaving until they transferred the money & the funds were showing as cleared in my account end of.

That's easy to say, but it won't be an insignificant amount of money, and if they simply don't have it, camping out in their showroom won't make any difference.

This is an awful situation and I've been in one not dissimilar myself.

To all those saying bring in the heavies, or sit in the office until they cough up I'm afraid playing the hard man, even if you are a hard man and have a ready, willing and able bunch of heavies at your beck and call it wont work.

Let's say you find the owner and threaten him, what are you going to do? Beat him senseless? Will that get the money, will it get you arrested and charged with some pretty serious offences?

This guy will be threatened on a regular basis, it'll be water off a ducks back. Your only hope is that he doesn't want to go to prison and coughs up, not because he is scared of a beating.

And as for sitting in his office and refusing to leave until you get paid, he will either call the cops and they will make you leave or you'll be locked in!

For a couple of ££hundred a threat may work but not in this case. The legal route is your best bet.

many years ago...had a bad payer ...about 10 grand, months of letters ,phone calls , the usual cheque in the post etc.

so we knew where he lived... got a mate to park a lorry across his driveway ...blocked him and his wife in the property,

my mate says he heard her screaming at him about stting on his own doorstep ... he went to the safe and gave my mate cash!

schemers always have an escape plan....passport and cash together for when the st hits the fan....

It's not easy to say & it's much harder to do, I've had to do exactly that for a different matter guess what in the end I got my money it took nearly 9 hours out of my day but I ended up with my money.

Has anyone said they don't have the money?

Even if that was the case I'd be leaving with a car as to ensure my money was transferred.

OP - I know I'm a lazy git but living in Scotland and selling the car in Manchester seems a bit of a hassle. Wasn't there anywhere closer to you that provided an equivalent service?

You need to visit a good solicitor first thing this morning, under no circumstances should you wait until Wednesday.

I've been here and unfortunately it ended badly. Do you have any finance outstanding on the car? If so you need to involve them ASAP and and get their recovery team on this straight away.

Unfortunately the likely scenario is that the car has been passed on to someone else who they owe money to and will then get re-sold quickly, at which point you have no hope of getting it back as it will have been sold in good faith. There may be a slim chance at the moment but only if you employ a solicitor who knows what they are doing.

I hope the rest of you out there take note of this situation - NEVER LET ANYONE TAKE YOUR CAR AWAY TO SELL ON YOUR BEHALF, this scam seems to be so common it defies belief. The guy who did this to me I had known for many years and appeared to have a stable business. After the event I found out that he had had at least 5 other people over in the same way, around the same time just through the circle of friends I have, I suspect there were many more. He of course went bankrupt shortly after I had CCJ against him and started the business up again overnight, at the same site with with almost exactly the same name and his son supposedly running the show.

I really hope you get paid or the car returned

Lawyers and police now involved. This could be a long one. I will update when we get a resolution.

I'm sorry to hear this: thanks for keeping us updated. I think we all feared it might end up like this. Chin up and let's hope that you get what you're owed and that the sleazebag eventually gets convicted and buggered in the shower every night.
