"Bait and switch" is one of the FCA's 31 banned practices, under the auspices of Treating Customers Fairly. Which are guidelines, not law. Might just see a fine from the FCA if a firm is engaging in the practice aggressively and consistently.

Assuming it's true you're better off without him as a customer. If you get this sort of behavior before collection it's often a good indicator of grief yet to come.

Most dealers, us included, insist on a deposit on order. Most would be retaining some or all of the deposit for this sort of cancellation.

Middle of last year I was looking to trade in my C63 at an MB main dealer and they had available a C300 (I think) Cabrio, almost new, advertised on the MB UK website etc... It was located elsewhere but wasn't a problem as they could get it over. I'd seen one almost identical on their site so was happy without seeing the car in person.

The deal was done, deposit paid, with the car being available for collection in a week. I phoned a couple of days before the agreed collection date to check all was still ok as I hadn't heard anything subsequently. After a bit of umming and errr and "we'll call you back...", I did receive a call - after chasing again - to be told that the sales manager was going on holiday for two weeks in it and so it'd be a few weeks until I could have it. Right... so a car with a few hundred miles on it is going to come back with quite a few more hundred miles on it, post sales managers holiday. And you expect me to just accept this? Needless to say I went ballistic at them and - eventually, after contacting the dealer principle - got my deposit back.

To rub salt into the wound, the Sales Manager called and said he had another one similar coming in, in a few months time - and would I be interested? Right, you can't deliver the car you actually have, so what makes you think I'm going to be chomping at the bit to get hold of one that you don't have?

Well done Mercedes, you managed to p*** off a potential long-term customer, certainly such that I wouldn't be going back to the dealership in the town where their UK head office may or may not be, and potentially not for quite some years.

I think they big-up their "we're Mercedes" too much and are frankly the same as any other main dealer i.e. you get good and you get bad, but having a 3-pointed star doesn't give you any divine right to claim you're better than anyone else.

Sounds like the car was never available and all they were doing was keeping your deposit until they could maybe find another car to offer you.

hi chaps.
not purchased a car for almost 6 years...(record for me)
owned 20+ cars from a metro to a mk1 MR2 to a fiesta rs and now a SAAB aero 'vert.)
.
seen a POLO GTI 2015 that I quiet like (alternative to a fiesta st I suppose)
its for sale at a VW main dealer with 19k on the clock.

sent a question saying..
I was interested in the car, but 1 question before I want to view was.....has it been serviced yet?

first reply..4x A4 pages about offers, videos and extra photos...no answer to my question

thanked them for the information about the company, but has it been serviced....

second reply....thanking me my email and when would I like to see the car...and he has created a video for me...no reply to my question

thanked him again for his email...and replied....before viewing the car...has it had any oil replaced since being manufactured in 2015.

YEP....I am getting that feeling...
the amount of 3-5 year old cars I am coming across that say "not been serviced yet as not required" is amazing....ie a fiesta st 2013 with 11,000 miles and never been serviced
yet service book says "12,500 miles OR 12 months which ever comes first"
.
ho hum...
when I sell my saab the buyer will get a surprise...serviced yearly for 12 years...and only 55,000 miles....(the service book says 17k or 12 months...hmmm maybe I should only have serviced it 3 times....)

If I ask a franchised main agent to find me a specific used car will they throw the enquiry in the bin after a day or is there a online system to flag up a matching car to enquiry?

No. Maybe after 2-3 days. hehe

Their currently available stock at the point of enquiry will be on their website or they can check with their manager or buyer if there's anything similar pending or been offered as a trade buy recently.

Yes, it's called AutoTrader or you keep an eye on the manufacturer's used car site.

The perfect car that you're after may be in current stock. With a different dealer group so they can't offer it to you anyway.

Whilst you may say "but surely you can look on the customer's behalf, it doesn't take long" - multiply it by the number of people who ask this, facto rin that I don't even have time to look at AT during work time to buy and sell my OWN cars and you'll realise why it gets filed in the round cabinet.

I will usually sit with the customer who asks this, run through the national search on my manufacturer's site andpoint them in the direction of that retailer if the car exists. If it doesn't, flick to AutoTrader and carry out their search, showing them how to use the page whilst doing so.
