I think the OP needs to straight talk with the insurance company and explain that you knew tinted windows were a mod and that's why you informed them, but an exhaust replacement would not bet a bit like tyres (not wheels), wiper blades are not.

You've acted in 100% good faith by declaring the "mod" you knew about, the exhaust was not like you sort a performance exhaust, it was a like for like replacement, but in a different material to last longer (which the garage can confirm) as simple as that.

If they don't accept that ask for their complaints procedure and say you will also speak to the ombudsmen or citizen advice bureau.

Frankly the insurance company is being ridiculous in my mind (but experience has taught me that will try and get out of anything)

I would only respond to this thread with updates from what the insurance co/ombudsmen say. everything else is internet spectulation on what is right/wrong (which this response can be included in)

Of course the flip side is that lots of people don't declare even patently obvious modifications, which is all well and good until it comes to making an insurance claim against the policy. I've seen it a lot where undeclared modifications have meant that indemnity has been withdrawn. Unfortunately third party claims often get dragged along with these indemnity issues and cases take longer to settle, generally meaning they cost more in the long run. Insurers don't help themselves here as even when liability is clear an indemnity issue often makes them take their eye off the ball in relation to a claim being made against them by a third party.

I'm not saying that the insurers in this case will refuse indemnity for the clients vehicle. Gavia has confirmed that they could refuse completely or deduct an amount similar to what it would have cost had the mod(!) been declared. Of course it may be that the call recording is found and the client's evidence is accepted and all is well. Fingers crossed for the latter.

They have investigated and have said that I did tell them and they have failed to note it on my file.they also said they have deemed it as a replacement exhaust and not a modification.and the exhaust gives no perfomance gain.great news.

Out of interest, have they said how they're likely to approach apportioning blame? Your fault or pushing 50/50 or third party at fault?
