Good news is my brother is a barrister so they've done it to the wrong chap
I can't for the life of me think why, if your brother really is a barrister, you have asked for help on here. We are only amateur legal bods on here, whereas bro is the real life mccoy. What does he say?

So if this allegation is true someone happened to have a pair of the exact make, style and size of tyres worn down to the canvas as you had bought and paid for and were fitted to your car. That would have to be one hell of a coincidence.

Yeah they’re pretty standard off the shelf continental rears on an M3 that BM fitted.
It’s not really that much of a coincidence for some putrid foreskin of a scrote to spot a set of rears that fitted their car and swap them over.
My old man took the car in and it was there for a few days in a garage with a ramp and everything needed to swap it.
On the balance of probably someone is more likely to have swapped

I had continental tyres on an E39 M5 they literally lasted 3000 miles and I wasn't thrashing it everywhere.
Never again.
If they had been swapped did they balance them? It's unlikely they would have bothered so go check.
Also check the date of tyre manufacture, there is a small oval with two numbers in on the tyres.
Example 5210 or 1102 or 0617 or 0415.
This relates to the week number and year they were made.
If all four were changed at the same time they will probably be off the same batch. If there is a discrepancy in the dates front and rear....

This is a made up story....
Could be based on a true story, just somewhat inflated ferg1986 said:
Brilliant to have the full range of opinions including the Brains Trust and helps me get some traction on what to do next. We're popping in this week after work one day and will take it from there
......but have you checked the DOT codes??(as many people are suggesting you do).
Seems like a very sensible thing to do to quickly ascertain if (i) the fronts and rears match or (ii) are wildly out.
If (i) then you may have accidentally shredded them yourself, your bushes may be crocked or the garage may have been doing burnouts.
If (ii) then they might have been swapped.
