My friend has got somewhere with the DVLA, car is still in his name, so car has been registered as stolen so the poor buyer is going to be out of pocket now.
Your friend may be in for a shock. If he gave the Company the right to sell his car on his behalf, then it hasn't been stolen. It's also unlikely that he will get his car back if it was legitimately purchased by the current owner.

So my contact has been down there just now. Managed to retrieve his car after talking to the administrators. He is one of the lucky ones.

I’m assuming any cars being sold as sale or return for a customer - which had remaining finance the finance would have had to be cleared first leaving the residual at risk for the seller

Absolutely, I bet he let out a big sigh of relief as he drove away. I sold a car to a Subaru dealer years ago and trusted them to pay off the finance for me, infact I gave them £600 to take the car off my hands.

I stupidly assumed they would pay the finance off immediately, was a few nervous weeks of me checking with IM finance every few days before I got the all clear.

Would never risk leaving a car with anyone without the money in my account again.

Unsure on the finer details, but I gather car is still in his name and they have issued a copy of the V5 in his name to his address

Car was MOT'd 9 days ago so would assume it was also sold around then too.

DVLA have put a marker on the file for when new owner tries to register it.

Unsure on anything else at this stage

It was greatly appreciated. Sadly the M5 was not there.

Also looks like the M5 has been used regularly as it has 1000 extra miles on since it was dropped off to be sold

No, and no.

If the company sold the car as per the agreement with the former owner of the car, then the new buyer owns the car, irrespective of the name on the V5.

Your friend needs to take up his case with the administrators as they are now responsible for the business. Sell Your Car should have kept the client funds separate from their trading funds. If this has not happened then the likely course of action is firstly via the administrators and then the courts to recover those funds from the directors.

Registering the car as stolen is simply incorrect, as is thinking it is the buyers problem. They have a receipt of sale, and your friend has a contract with Sell Your Car giving them permission to sell it on his behalf, which is what they have done.

I was contacted quite persistently by someone representing this company when I was selling my m240i earlier in the year. Part of me was tempted but recalled some of the other SOR horror stories of past. Glad I took the hit selling direct to the trade, tho that was through wizzle who are also no more!

I’ve sold 2 vehicles with these guys totalling 42k. Haven’t got any troubles getting the funds from them. Something must’ve gone wrong this year.

Very naughty. Wee bit more than test drive usage to sell.

Surprised they don't have an arm in airport parking either.

Here's the thing they want it to be successful to grow the business where it comes to contentious is whether they over extended and it failed or they were just waiting to get a large stock sell loads and cut and run ie how much was planned and how much just poor business control.

Either way you can say with almost absolute certainty that those in charge will be firmly hiding behind the limited liability as much as possible and won't be getting poorer trying to sort out the innocent victims in this.

I am afraid DVLA or registered keeper means nothing and cars that are not recovered are gone. I suffered a similar loss with a company in Nottingham in 2007 selling a left hand drive S3. No car and no money.

Best of luck for those involved.
