3 weeks ago I placed a large deposit on a used bike from a Ducati main dealer. Part of the agreement was the bike would be ready for collection 2 weeks ago. It still isn't ready, and I have since spoken to the previous owner and discovered they were the 3rd owners of the bike. Not the 2nd as I had been advised by the dealer. Am I be entitled cancel the purchase, and to have my credit card deposit returned?

Yep, dealers problem. It sounds like they may need to raise their game regarding due diligence and trades description.

Not ready, perhaps they need to do more than they thought. Talk to them, not us.

Does the amount of owners matter? Three doesn’t sound like a massive issue, at least to me anyway. I’d be more narked about the time it’s taken to sort out.

Ask the last owner about the bike. Only 1800 miles yet 3 owners? Why the quick turnover of owners? Do this first.
An extra 2 weeks to prep such a low mileage bike for sale? What is causing the delay? What reason is the dealer giving other than workload? Surely such a low mileage bike would be a fast turnaround in a pre sales prep? Unless there are problems resulting in 3 owners getting rid of it.
Is the dealer the one who sold the bike new to owner 1?

My bet is the first registration was by the Ducati dealer to meet contractual volumes. Then sold to first 'real' owner, then second 'real' owner.

Why do you need a lawyer? Talk to the dealer, find out what is taking so long, who knows, maybe half the staff are sick with C19.

"The bike has 2 previous owners" It has had 3. Misresrepresentaition.

Please can you refund my deposit?

It's as simple as that.

Have you contacted your credit card supplier?
Have you asked the dealer when the bike will be ready?
Have you spoke to a solicitor?

Hmm. I say what went wrong here is that you ordered a ducati. Best course of action is to get your deposit back, and take it to a proper manufacturer.

A lot of fair weather bikers (like me) like the idea of a Ducati, but when they actually own one for a bit, they realise it's not for them. Therefore, I personally wouldn't worry about the number of owners unless it was an excessive amount for the age and miles.

What is the value difference between and 2 and 3 owner bike? NIL I expect, although I can empathise that the dealer allegedly misrepresented it. I'd be much more worried about the delay, especially now the nice weather is here.

What outcome do you actually want? If they have delayed giving you the bike, I don't think it's unreasonable for you to back out of the deal and get your deposit back. They are the ones who broke their side of the deal.

It does seem that some people buy a Ducati to look at rather than ride. The dealer has offered to refund my deposit.
