I'm not arguing fault, but the BMW has made no attempt at all to avoid an accident - if he'd stuck 2 wheels on the verge, the van may well have passed with an "oh st" moment rather than actual contact and I'd take that every day over the hassle of an insurance claim.Surely there is a possibility that both vehicles were driving towards each other and the van was the one that made the decision to take evasive action ? The BMW could still have been moving at this point and only come to a total stop once the van had gone up onto the verge ?

Or maybe he stopped in plenty of time and sat watching a van driven by a bloke asleep/on the phone/reading a delivery address heading towards him oblivious...The thing is we don't know the exact circumstances, but the owner of the van is pretty confident it was his driver's fault and has paid out for repairs without argument.
Got to say looking at the pic, to me it appears:
1)BMW comes around corner.
2)BMW sees delivery van (presumably doing warp nine as that's standard procedure)
3)Van driver realises van doesn't stop as well as whatever car they drive.
3)BMW stops, probably starts looking in mirror to see where to reverse back too.
4)Van swerves as best they can once realisation dawns they are crashing.
Bang.
Wallop.

3) Could be, we don't know what the road behind the van is like, could be a corner could be a 1 mile straight?
Either way, a ridiculously common crash on countryside roads.

As aka_kerrly said, absolutely no need for a crash like this to occur on country lanes, drive round each bend expecting there to be oncoming vehicles. That way you don't smash up other people's cars by being a thoughtless lunatic.

Two days ago our heli crashed on the Mutnovsky volcano in Kamchatka, Russia. Three guys were ejected from the open door, with one suffering spinal compression and another with knee injuries. Inside the chopper we had two broken necks, broken ribs and various minor injuries. Very fortunate under the circumstances. The injured are stable and will be flying back to their home countries soon. I escaped with no more than bumps, bruises and whiplash.

Insurance just settled 2 days ago. Other side took full liability after I pushed them a bit (refused there request for 50/50 settlement and sent some wordy letters). Land rover driver decided to change lanes into the front wing of my car as I was passing him, only left the road briefly as I managed to yank the car out of the ditch back onto the road whilst I was still carrying momentum, I think it was this action which completely sheared my front left tie rod and I think buckled some of my front end (engineering report cited chassis damage for cat C write off).
Managed to drive it home... Very very slowly with the wheel at ~90degrees dragging the front left wheel .

A bit mundane as this thread goes, but this is the front end of my car after my "friend" drove it into a metal bollard in Tesco's car park. Nothing that won't buff out. "Friend" was paying too much attention to the children throwing around a traffic cone. Friend then proceeded to give nearby shopping trolley a shove with the car for good measure.
Sum of the damage:
Scratches on the numberplate.
Scratches on the front bumper.
Minor deformation of the above bumper.
My car was very lucky, and seems to be made like a tank for something so small and diddy.
It did what the titanic should have done: hit the iceberg head on, rather than have it scrape down the side. Reduced the damage imensely.

Incredible story and a lot of lucky people who hopefully make a full recovery, if i send you some money please purchase a lottery ticket on my behalf

I recon the BMW driver has taken the dog for a walk and parked the car there, the van driver was trying to get past.2) BMW drives past a perfect pull in
