The flaw in your reasoning is that the OP's insurance company will currently have to pay out to fix his car. If they could lay the blame 100% at the other driver's door, his insurance company would have to foot the bill for both cars.
This doesn't always happen as the Insurers often have knock for knock agreements and they each pay for their own repairs.
No they don't the knock for knock agreement which was industry wide disappeared decades ago.

There are strict rules in place for insurers agreeing liability in accidents, most of which if unresolved end up with a court settling it ad guess what, in the absence of witnesses, then a court will 99% of the time find each oarty to be equally to blame.

As for accidents where the insurer insures both parties, then there are some unbelievably stringent guidelines in place to ensure it is treated independently by that company.

The ABI has designed a matri for easy resolution of accidnets based on the circumstances and the likely findings of a court if it goes that far, to try to minimise claims costs by avoiding the need for expensive cases and solicitors.

As for the OPs NCD then it will already have been "stepped back" by 2 years (assuming first accident in policy year), as it is a No CLAIMS Discount not a No BLAME Discount, until the accident is reolved then his NCD will be reduced from the maximum 5 years.

Only in clear and agreed Non-fault accidents will the NCD not be stepped back prior to his insurer getting full recovery on their outlay.

I have someone trying to put me at fault for her crashing into the rear of my vehicle. She was driving with no L plates on and a minor in the passenger seat of her car.. and yes you guessed right SHE ONLY HAS A LEARNER LICENSE , WITH LEARNER INSURANCE!!! My insurance would not touch it or repair my vehicle once she had disputed my claim!! I had to go through my legal cover and now they're saying they may not be able to get her to admit full liability for it??? How is that possible as she SHOULDNT HAVE BEEN ON THE ROAD UNACCOMPANIED 😫
