You are right though, the seller is not telling everyone the truth, but he's probably used sufficient terms to be this side of the law. He's read the mileometer, and he's admitted it might not be genuine.

I'll stick by my opinion that the seller is a chancer, he's bought a car with the intention to try and make a profit, and thinks he's "smart" by listing that he doesn't know if the mileage may or may not be genuine.

See it would be different if he came across the car not knowing, but he bought it knowing full well what the mileage was.

I'd agree that bangers are to be sold as seen and bought on condition rather than description, infact only an idiot would buy a car on an internet description without seeing the vehicle in question before hand.

I just don't think regardless of how people spin it, that it's right to purposley try and mis-lead someone.

What he is doing is lying, he knows 100% what mileage the car has, and he is just as bad as someone who would clock a more expensive car and then attempt to sell it in my opinion.

The only difference between this particular ebay seller and other scammers is the ebay one is clearly clueless, with the trail he's left behind.

I mean think about it, even though he's put what he thinks is his "get out clause" to plead ignorance, he's left a trail showing that he bought the car knowingly with an advertised 116,000 miles.

Although he'll probably claim he's dyslexic, and will get a no win no fee solicitor to fight his case and be awarded £1000000000 for discrimination rolleyes

He hasn't told you the mileage, he has merely told you what it is showing on the clock.

The seller is as bad as the people who would set up auctions for empty boxes for say playstation 3s, they would word the auction in such a way that they'd have a get out clause in that they didn't say the ps3 was in the box, and they didn't outright say they were bidding on an actual console, but they would lead the potential buyer into thinking they were bidding on a ps3 console.

Unfortunately anyone who buys the car in the belief that it has a genuine 16,000 miles will not be smart enough to look through his buying history and see that he bought the car knowing it had 116,000.

p.s we know he hasn't clocked the car, that's why I called him a chancer, he's not a "pro scammer", he's just trying it on.

Only a defence if honest and genuine belief. Negligent or indeed dishonest misrepresentations can still succeed.

I was just saying that he's a chancer as opposed to being a hardened car criminal.

It is funny how things can be deemed acceptable if it's not a huge amount of money.

I can go and rob an old lady tonight, it's only for £50...

I've been saving up for a pair of tyres for my car the last few months, if I'd known small sums were okay I'd have just gone and nicked them!
