From the manual on page 165:
Regulation according to the vehicle in the adjacent lane
During regulation your vehicle may be regulated according to the vehicle in the adjacent lane.
This could occur at speeds above 80km/h when your vehicle is moving faster than the vehicle in the adjacent lane on the driver's side. The display shows the detected vehicle is in the adjacent lane.
Apologies if I have misunderstood what you are saying.
EDIT: reread the original comments, and can see you are having issue no mater which side you are passing on. Obviously this needs repairing. On my superb I didn't like the fact you couldn't use cruise without ACC. When ever it snowed it would refuse to work, and on a number of occasions slammed on for no reason at all. Overall though I thought it was great, but found the system in the XC60 to be far better (only used for a limited time though).

The "ACC preventing overtaking" seems to be a common issue across anything on the latest VAG platform.
I'm waiting on a new Octavia and there are loads of people with the same issue. Basically car decides you're in a LHD country and stops you overtaking people as it thinks you're "undertaking".
I'm hoping they fix it before I get my car as I use cruise all the time so it will really annoy me. Unless I can find some way to make it "normal" cruise rather than adaptive...

That's the issue: undertaking prevention. I bought OBD11 Dongle yesterday and coded it out. It makes huge difference. Also switched off permanently Lane Assist, but still have to switch off at every start: start/stop, front collision and emergency SOS. I'm waiting on a new Octavia and there are loads of people with the same issue. Basically car decides you're in a LHD country and stops you overtaking people as it thinks you're "undertaking".

I just don't understand why I had to spend £70 to fix it myself, because there's no official fix to this known error.
Still waiting for quotes from dealers regarding early preferential termination. It must be taking time to get it, because none of the 3 dealers contacted me back yet.

Some of them also do a thing (which may also be connected to LHD/RHD) where the system picks up 70MPH entering a motorway, but displays 110KPH (which is pretty close to 70MPH). It then sees the next 70 sign and slams the anchors on as it thinks its 70KPH!I'm waiting on a new Octavia and there are loads of people with the same issue. Preferential termination is only applicable as part of a deal with the nominated dealer. Even then not all dealers will offer it, it really depends on whether they want your car. It’s basically an part exchange for them.
I found 3 different cars and told dealers that I want to do preferential early termination. One of the steps is to get purchase price from VWFS and it's something that only dealer can do. When they get the quote from VWFS, they will decide if they want to purchase my current car at that price and proceed with selling me the car they have and set up finance on it.
I'm at the stage of waiting for their call after they get quote. No one called me back yet, so they must be waiting for a price from VWFS.
In fact my insurance policy has the following section -
So according to this you can't win. I have faulty car sold by Cupra, there's no official fix, car is dangerous because it brakes when it shouldn't, but me switching this function off, supposedly invalidate insurance (depending on insurer). My policy doesn't have such clause.
I already had one situation, I thought van will slam into my rear, when my car mistaken cars parked on the side of the road as stopped traffic and braked heavily, when there was no such need. And it was part of ACC, because I switch off front collision at every start. Van could not expect me to brake, because he could see, that there's nothing in front of me. So I probably looked like dangerous idiot. The same way, I look when I slow down for no reason on motorway.

I've had no luck getting a VAG dealer to even talk about "preferential early termination" most claiming it's not a thing.

I need to pay the get out fee of £5170 plus then buy the car for £31000 bear in mind also to date I've paid 2400 + (405 x 16)
so the car would end up costing me when I could have bought it brand new in March 2020 when I took the lease for £32k
It will end up costing me £45k

I’ve thought I was doing preferential termination a couple of years ago when I wanted out of an A4 and into a stock A6 Avant that had to be registered by a certain day due to emission changes.
The dealer was v keen to get me into the new car so we agreed to preferential terminate.
However when my old car got picked up it went straight to auction. I spoke to the dealer and it transpired that it was cheaper for them to pay the early termination cost (55% of remaining payments) then to preferential terminate.
The dealer was really keen as they wanted to shift a stock car in a hurry, but in this market I expect that they would rather just do a deal with someone else rather than bother with the faff of preferential termination.

Manufacturer allows you to switch off these features, so switching them off, doesn't modify anything in a car. It would be ridiculous if changing settings in the car would mean modification. My changes switched off Lane Assist permanently, which I was switching off at every start anyway. Undertaking prevention can be overridden by pressing gas pedal. But since software is faulty, I had to override all the time, so I can only say, that driving car was more dangerous, when it was slowing down for no reason and had to be overridden. I will be checking with dealers today, if they did anything. None of them said that termination was impossible. All said they will contact VWFS and check with them and took my contract information.
I was fully aware of lease limitations, so no complains here about PCH. It served me well over the years. I didn't expect the car to be so bad, to make me desperate to get rid of it. As I wrote earlier, if I was commuting in heavy traffic every day, car would probably be fine for that.
Got confirmation, that it takes 48h to receive purchase price after requesting it and dealers are waiting for it.

Just looking for some advice/guidance re: servicing for a Volvo XC40 I have on a 36 month lease from Santander.
I've had the car since September last year so it's approaching 1 year since I got it & the first service is due. I've just been quoted £260 for the first service from Volvo at Agnews in Belfast which I believe is the only official Volvo dealer in NI. This seems very expensive, especially in comparison to the servicing costs of my last few cars. There's not even 4k miles on the car yet as it was used so little during the lockdown last year. Just seems so sickening to have to pay so much for servicing such a relatively new car with so few miles on it.
Anyway.......does anyone know if there are any cheaper servicing options or does it have to be done at an official Volvo dealer? & I'm correct to say that lease cars have to be serviced at least once a year or you're charged a fee at the end of the lease? I know I should probs know the answer to this but I can't find my Santander paper work from last year.
Any help/advice/recommendations is appreciated.

As for continuing to drive a car you believe to be faulty and dangerous because of that fault, well I can’t see the insurance company being happy with that either. Would you drive a car if you thought the steering or brakes were faulty?Is anyone else caught between a rock and a hard place at the moment? I don't really want to lease or get another PCP - ideally I'd get a nearly new car. However, used car prices are so ridiculous that I'm looking at a 2018 car with 50,000 miles on it to make any significant savings. This just leaves me spending a little more than I'd like on a new XC40 9+48 £333pm 15kpa (RDesign T3 auto with £1500 worth of paint/options). However, cheaper models like the T-Roc and Q2 are actually not much better value for what you actually get. Still, the XC40 is a good deal for a nice car, but still a lot of money!
