Rejecting a New Car

Good morning all
I purchased a new car in September, but I have been having issues with the gearbox. Unfortunately, the gearbox occasionally locks out 4th gear when changing down from 5th. I reported this to the manufacturer after 28 days of ownership, they advised me to take it to my local dealer as the supplying dealer is 480 miles away (long story). The local dealer drove it for about 10 minutes, but could not replicate the issue. Fortunately, my wife managed to record the issue when I was driving the and this was forwarded to the manufacturer. The manufacturer’s response in short was “we know there is an issue, but we can’t fix it”. As a result, I have rejected the car for a refund. The dealer and their legal team are in discussions with the manufacturer at the moment. Any advice on this issue would be very much appreciated.

If they’ve accepted that the fault cannot be fixed (and put it in writing) then you will be fine. The discussion will be around compensation and if I were you I would build a case for out of pocket and inconvenience.
A mate of mine had ongoing electrical problems with a new MB recently, after six months they replaced with a new car and handed him £3k in compensation, he did well. Many years ago I had an Espace that kept running the battery flat, after months of inconvenience we discovered that the electronic handbrake was turning itself on an off when the car was parked up, no known fix so they scrapped the car but I had an almighty fight getting compensation, it took two solicitors letters and a small claims court notice to get a response.
