He said he would return the deposit and he invited me in his house to write down my bank details

Either way the car was clearly mis described and i'm also thinking he might be a car dealer pretending to be a private seller.

My take is that he did buy the car a run around then realised he had bought a pile of sh*t and wanted to pass it on to the next punter.

I’d ask again for your deposit or that you’ll report him to the dvla and trading standards.

Sounds like a dealer pretending not to be, did he have the full v5, or less the trade section?

And tell him if he doesn’t sort it soon you’ll be pursuing him for your costs - fuel, time wasted, etc, etc.

Cheers for the replies, the guy had the full V5 but it wasn't in his name or his address. The selling to a trader section was still present and had some writing on it as i challenged him on why the V5 wasn't intact and registered in his name.

He had removed the section selling to a trader part as this had some writing on and he claimed it was because of GDPR regulations it had been torn off but this hadn't been sent off to the DVLA.

Is there a way to see if the previous owner sold the car to the guy who told her he was a trader and would complete the V5 transfer then didn't bother to complete the submission as required

Either way it all sounds a bit fishy to me and a call to trading standards might be needed but will wait and see if my money is returned by the end of the week if not i will file a claim for my part payment , 5 hours wasted time and fuel expenses etc.

On that basis he is a trader, check if the car is taxed or is sorn to validate.

I went to see an Audi offered for sale by a trader.

I liked it and left a £500 deposit but negotiated the 1 month MOT was renewed with a fresh 12 months.

He then got back to me to let me know it had failed due to emissions caused by a cracked cylinder head.

I said I still wanted it if the issue was sorted and a fresh MOT provided.

He agreed and 2 weeks later he called to tell me it was ready to collect.

I travelled the 40 miles (again) to collect it and decided to check it over before paying up and driving off.

Good job I did; it ran like a pig and billowed clouds of smoke and ran on only 4 cylinders.

I said I was not happy and wanted it running properly before I paid the balance and took it. I left it that he'd sort it and call me when ready.

Another 2 weeks passed and no word so I called him and he informed me he had sold it to someone else.

I obviously asked for my money to be returned and he flat out refused and justified keeping my deposit by saying that he had been subjected to the additional expense of rectifying a fault due to my request for the 12 months MOT so I had caused him to spend money he hadn't needed to.

I never did get a penny back unfortunately.
Thats why we have small claims courts

Any way as an update i sent him a formal Pre Court Action letter, he finally replied asking me to call and discuss, i replied saying put it in writing to the address on the letter or simply return the £155.

!0 mins later the £155 appeared in my account and the girl this chancer was trying to rip off was happy again.
