I've said my piece about the 'ballers and am not going back there, but the car confiscation thing still riles me - it's utterly disproportionate. I absolutely hope that the effective £100k+ fine is challenged in court, though it's a shame the French govt legal costs will hit taxpayers.

I for one would be devastated by this type of action - did Verbier to Calais in 7h 45 a couple of years ago, I spotted the laser-gun gendarme near Calais and ambled past at 70 mph... it would have been a different story if I'd not seen him, the roads were empty and in perfect condition for safe speed. I would not be able to shrug off financially this type of action.

And to those saying 'if you can't do the time, don't do the crime' - that's not the point. The government could, after all, choose any penalty for this victimless crime. How about life imprisonment and having your family raped and shot? Disproportionate penalties simply confirm that the laws are not about safety but simply cynical socialist control-freakery, which quite simply gives me no incentive to follow the law.

The shift in rationale for being a law-abiding citizen is moving from common-sense consensus that the laws are a good thing (and therefore self-perpetuate and uphold them), to simple totalitarian oppression. People only comply because they are scared of the consequences, not that they agree with them. I thought we'd got away from that sort of shit ages ago after countless civil and world wars. It's a shame.

If the car had £75k finance on it, would the owner still have to pay that off, or could finance company take it back from french cops?

Are we sure this is true?

I was under the impression that the french pigs only confiscate your car if you can't pay the fine on the spot, but release it when it is paid.

I may be wrong.

A guy last year had his ford focus RS confiscated(at the first toll from Calais) for 5 months after being caught speeding at 125-135 mph. The car was on finance and he did get them involved but they couldn't do anything. This may be different if they were actually confiscating the car for good.

This year was a lot better for him on the RR he only managed to go 175 miles the wrong way on the first day and on the last day a car pulled out on to him on a Autobahn. I dont think he's coming next year.

If you are cought at over 45kmh over the limit the law in France says confiscation IIRC!!!

40kmh over the limit is loss of license and a ban in france for 14days, all you do is take a passenger and insure them just in case.

they have confiscated cars from speeding offenders in holland for years though, there was a 20 year old with a 360 cuaght speeding twice and the third time they took it of him, was his dads car too!! i would have killed him. they sell it at auction and the money goes to the police.

I wouldnt be suprised if they do it in france too

true *but* the car didn't belong to him so they're not in effect penalising him by taking his toy away.

not to say a civil case couldn't be brought against him by his dad...

Erm, just thinking about this a bit (tearing my mind away from Katie Puckrick for a minute or two), what if you were to report the car as stolen to UK police, and claim on your insurance policy? Give them all the details, and claim that the vehicle was taken against your consent.

Thinking aloud, I presume that the UK BiB wouldn't want to get involved because the crime didn't happen in the UK. And also they may not view it as a crime, as it happened as part of a due process of law.

Hmmm.
